أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ قَالَ حَدَّثَنَا حَبَّانُ قَالَ حَدَّثَنَا أَبَانُ يَعْنِي ابْنَ يَزِيدَ الْعَطَّارَ قَالَ حَدَّثَنَا قَتَادَةُ عَنْ خَالِدِ بْنِ عُرْفُطَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ أَنَّ رَجُلًا يُقَالُ لَهُ عَبْدُ الرَّحْمَنِ بْنُ حُنَيْنٍ وَيُنْبَزُ قُرْقُورًا أَنَّهُ وَقَعَ بِجَارِيَةِ امْرَأَتِهِ فَرُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ فَقَالَ

«لَأَقْضِيَنَّ فِيكَ بِقَضِيَّةِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ» فَقَالَتْ أَحْلَلْتُهَا لَهُ فَجُلِدَ مِائَةً قَالَ قَتَادَةُ فَكَتَبْتُ إِلَى حَبِيبِ بْنِ سَالِمٍ فَكَتَبَ إِلَيَّ بِهَذَا

✧ “I will judge in your case by the judgment of the Messenger of Allah ﷺ: if she had made her lawful for you, I would flog you one hundred lashes; and if she had not made her lawful for you, I would stone you with rocks.” Then she said, “I made her lawful for him,” so he was flogged one hundred lashes. Qatadah said: “I wrote to Habib b. Salim, and he wrote this back to me.”
