al-Sunan al-Kubra (al-Nasa'i) 4940

✧ servant comes between two people, and one of them will free him, and the narrators differ in reporting the news of Abdullah b. Umar in that matter.

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا عَبْدُ الْوَهَّابِ قَالَ سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ يَقُولُ سَمِعْتُ نَافِعًا يُحَدِّثُ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ قَالَ

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي مَمْلُوكٍ كُلِّفَ مَا بَقِيَ فَأَعْتَقَهُ» وَكَانَ نَافِعٌ يَقُولُ قَالَ يَحْيَى لَا أَدْرِي شَيْئًا كَانَ مِنْ قِبَلِهِ يَقُولُهُ أَمْ شَيْءٌ فِي الْحَدِيثِ «فَإِنْ لَمْ يَكُنْ عِنْدَهُ فَقَدْ جَازَ مَا صَنَعَ»

✧ I heard the Messenger of Allah ﷺ say: “Whoever frees a share of his in a slave, he is responsible for the rest, so he frees him.” Nafi' used to say: Yahya said: I do not know whether it was something he said on his own or something in the hadith: “If he does not have it, then what he did is valid.”
