✧ The spoils and their distribution

أَخْبَرَنَا عُمَرُ بْنُ سَعِيدِ بْنِ سِنَانٍ بِمَنْبِجَ قَالَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عُمَرَ بْنِ كَثِيرِ بْنِ أَفْلَحَ عَنْ أَبِي مُحَمَّدٍ مَوْلَى قَتَادَةَ عَنْ أَبِي قَتَادَةَ الْأَنْصَارِيِّ ثُمَّ السُّلَمِيِّ أَنَّهُ قَالَ

خَرَجْنَا مَعَ رَسُولِ اللَّهِ ﷺ عَامَ حُنَيْنٍ فَلَمَّا الْتَقَيْنَا كَانَتْ لِلْمُسْلِمِينَ جَوْلَةٌ قَالَ فَرَأَيْتُ رَجُلًا مِنَ الْمُشْرِكِينَ قَدْ عَلَا رَجُلًا مِنَ الْمُسْلِمِينَ قَالَ فَاسْتَدْبَرْتُ حَتَّى أَتَيْتُهُ مِنْ وَرَائِهِ فَضَرَبْتُهُ عَلَى حَبْلِ عَاتِقِهِ ضَرْبَةً فَقَطَعْتُ مِنْهُ الدِّرْعَ قَالَ فَأَقْبَلَ عَلَيَّ فَضَمَّنِي ضَمَّةً وَجَدْتُ مِنْهَا رِيحَ الْمَوْتِ ثُمَّ أَدْرَكَهُ الْمَوْتُ فَأَرْسَلَنِي فَلَحِقْتُ عُمَرَ بْنَ الْخَطَّابِ فَقُلْتُ لَهُ مَا بَالُ النَّاسِ؟ فَقَالَ أَمْرُ اللَّهِ قَالَ ثُمَّ إِنَّ النَّاسَ قَدْ رَجَعُوا فَقَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ قَتِيلًا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ» قَالَ أَبُو قَتَادَةَ فَقُمْتُ ثُمَّ قُلْتُ مَنْ يَشْهَدُ لِي؟ ثُمَّ جَلَسْتُ ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ قَتِيلًا لَهُ عَلَيْهِ بَيِّنَةٌ فَلَهُ سَلَبُهُ» فَقُمْتُ ثُمَّ قُلْتُ مَنْ يَشْهَدُ لِي؟ ثُمَّ جَلَسْتُ ثُمَّ قَالَ الثَّالِثَةَ فَقُمْتُ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا لَكَ يَا أَبَا قَتَادَةَ؟ » فَاقْتَصَصْتُ عَلَيْهِ الْقِصَّةَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ صَدَقَ يَا رَسُولَ اللَّهِ وَسَلَبُ ذَلِكَ الْقَتِيلِ عِنْدِي فَأَرْضِهِ مِنِّي فَقَالَ أَبُو بَكْرٍ لَاهَا اللَّهِ إِذًا لَا يَعْمِدُ إِلَيَّ أَسَدٌ مِنْ أُسْدِ اللَّهِ يُقَاتِلُ عَنِ اللَّهِ وَعَنْ رَسُولِهِ فَيُعْطِيكَ سَلَبَهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «فَأَعْطِهِ إِيَّاهُ» فَقَالَ أَبُو قَتَادَةَ فَأَعْطَانِيهِ فَبِعْتُ الدِّرْعَ فَابْتَعْتُ مِنْهُ مَخْرَفًا فِي بَنِي سَلَمَةَ فَإِنَّهُ لَأَوَّلُ مَالٍ تَأَثَّلْتُهُ فِي الْإِسْلَامِ

✧ We went out with the Messenger of Allah ﷺ in the year of Hunayn. When we met, the Muslims had a turn of flight. He said: I saw a man of the polytheists mount a man of the Muslims. He said: So I turned my back until I came at him from behind, and struck him on the vein of his shoulder with a blow that cut the armor from him. He said: He faced me and squeezed me in a squeeze in which I found the smell of death; then death overtook him, so he released me. I caught up with Umar b. al-Khattab and said to him: 'What is the matter with the people?' He said: 'The command of Allah.' He said: Then the people returned. The Messenger of Allah ﷺ said: 'Whoever kills a slain man and has proof for him, his spoil is his.' Abu Qatada said: I stood up, then said: 'Who will testify for me?' Then I sat down. Then the Messenger of Allah ﷺ said: 'Whoever kills a slain man and has proof for him, his spoil is his.' I stood up, then said: 'Who will testify for me?' Then I sat down. Then he said it a third time, so I stood up. The Messenger of Allah ﷺ said: 'What is the matter with you, O Abu Qatada?' So I related the story to him. A man of the people said: 'He has spoken the truth, O Messenger of Allah, and the spoil of that slain man is with me; so satisfy him from me.' Abu Bakr said: 'No, by Allah, then a lion of the lions of Allah who fights for Allah and His Messenger would not intend to give you his spoil.' The Messenger of Allah ﷺ said: 'Give it to him.' Abu Qatada said: So he gave it to me. I sold the armor and bought from it a garden in the Banu Salama, and it was the first wealth I acquired in Islam.
