أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا إِبْرَاهِيمُ بْنُ الْحَجَّاجِ النِّيلِيُّ إِمْلَاءً مِنْ كِتَابِهِ قَالَ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ

أَنَّهَا اشْتَرَتْ بَرِيرَةَ وَاشْتَرَطَ أَهْلُهَا وَلَاءَهَا فَقَالَ ﷺ «اعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْطَى الْوَرِقَ وَوَلِيَ النِّعْمَةَ» قَالَتْ فَأَعْتَقْتُهَا فَخَيَّرَهَا رَسُولُ اللَّهِ ﷺ فَقَالَتْ لَوْ أُعْطِيتُ كَذَا وَكَذَا مَا كُنْتُ مَعَهُ قَالَ الْأَسْوَدُ «وَكَانَ زَوْجُهَا حُرًّا»

✧ She bought Barirah, and her owners stipulated their wala'. He ﷺ said, "Manumit her, for the wala' belongs to the one who paid the silver and took charge of the favor." She said: So I manumitted her, and the Messenger of Allah ﷺ gave her the choice. She said, "Even if I were given such and such, I would not be with him." Al-Aswad said: "And her husband was a free man."
