✧ The obligation of zakat

أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدِ بْنِ بُجَيْرٍ الْبُجَيْرِيُّ وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ بِبُسْتَ قَالَا حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ وَمُحَمَّدُ بْنُ الْمُثَنَّى قَالَا حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الْأَنْصَارِيُّ قَالَ حَدَّثَنِي أَبِي عَنْ ثُمَامَةَ قَالَ حَدَّثَنِي أَنَسُ بْنُ مَالِكٍ

أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ لَمَّا اسْتُخْلِفَ كَتَبَ لَهُ حِينَ وَجَّهَهُ إِلَى الْيَمَنِ هَذَا الْكِتَابَ «بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللَّهِ ﷺ عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللَّهُ بِهَا رَسُولَهُ فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطِهَا وَمَنْ سُئِلَ فَوْقَهَا فَلَا يُعْطِهَا فِي أَرْبَعَةٍ وَعِشْرِينَ مِنَ الْإِبِلِ فَمَا دُونَهَا الْغَنَمُ فِي كُلِّ خَمْسٍ شَاةٌ فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ إِلَى خَمْسٍ وَثَلَاثِينَ فَفِيهَا ابْنَةُ مَخَاضٍ فَإِنْ لَمْ يَكُنْ بِنْتُ مَخَاضٍ فَابْنُ لَبُونٍ ذَكَرٌ فَإِذَا بَلَغَتْ سِتًّا وَثَلَاثِينَ إِلَى خَمْسٍ وَأَرْبَعِينَ فَفِيهَا ابْنَةُ لَبُونٍ فَإِذَا بَلَغَتْ سِتًّا وَأَرْبَعِينَ إِلَى سِتِّينَ فَفِيهَا حِقَّةٌ طَرُوقَةُ الْجَمَلِ فَإِذَا بَلَغَتْ وَاحِدَةً وَسِتِّينَ إِلَى خَمْسٍ وَسَبْعِينَ فَفِيهَا جَذَعَةٌ فَإِذَا بَلَغَتْ سِتًّا وَسَبْعِينَ إِلَى تِسْعِينَ فَفِيهَا ابْنَتَا لَبُونٍ فَإِذَا بَلَغَتْ إِحْدَى وَتِسْعِينَ إِلَى عِشْرِينَ وَمِائَةٍ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْجَمَلِ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِئَةٍ فَفِي كُلِّ أَرْبَعِينَ ابْنَةُ لَبُونٍ وَفِي كُلِّ خَمْسِينَ حِقَّةٌ وَإِنَّ مَنْ بَلَغَتْ عِنْدَهُ مِنَ الْإِبِلِ صَدَقَةُ الْجَذَعَةِ وَلَيْسَتْ عِنْدَهُ جَذَعَةٌ وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ وَلَيْسَتْ عِنْدَهُ حِقَّةٌ وَعِنْدَهُ جَذَعَةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْجَذَعَةُ وَيُعْطِيهِ الْمُصَّدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ صَدَقَتُهُ الْحِقَّةُ وَلَيْسَتْ عِنْدَهُ إِلَّا ابْنَةُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِي شَاتَيْنِ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ لَبُونٍ وَلَيْسَتْ عِنْدَهُ إِلَّا حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ وَيُعْطِيهِ الْمُصَّدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ لَبُونٍ وَلَيْسَتْ عِنْدَهُ فَإِنَّهَا تُقْبَلُ مِنْهُ ابْنَةُ مَخَاضٍ وَيُعْطِي مَعَهَا عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ صَدَقَتُهُ ابْنَةَ مَخَاضٍ وَلَيْسَتْ عِنْدَهُ وَعِنْدَهُ ابْنَةُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ ابْنَةُ لَبُونٍ وَيُعْطِيهِ الْمُصَّدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ لَمْ يَكُنْ عِنْدَهُ ابْنَةُ مَخَاضٍ وَعِنْدَهُ ابْنُ لَبُونٍ فَإِنَّهُ يُقْبَلُ مِنْهُ وَلَيْسَ مَعَهُ شَيْءٌ وَمَنْ لَمْ يَكُنْ مَعَهُ إِلَّا أَرْبَعَةٌ مِنَ الْإِبِلِ فَلَيْسَ فِيهَا صَدَقَةٌ إِلَّا أَنْ يَشَاءَ رَبُّهَا فَإِذَا بَلَغَتْ خَمْسًا مِنَ الْإِبِلِ فَفِيهَا شَاةٌ وَصَدَقَةُ الْغَنَمِ فِي كُلِّ سَائِمَتِهَا إِذَا كَانَتْ أَرْبَعِينَ إِلَى عِشْرِينَ وَمِائَةٍ شَاةٌ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِئَةٍ إِلَى أَنْ تَبْلُغَ مِائَتَيْنِ فَفِيهَا شَاتَانِ فَإِنْ زَادَتْ عَلَى الْمِئَتَيْنِ إِلَى ثَلَاثِ مِائَةٍ فَفِيهَا ثَلَاثُ شِيَاهٍ فَإِذَا زَادَتْ عَلَى ثَلَاثِ مِئَةٍ فَفِي كُلِّ مِئَةٍ شَاةٌ وَلَا يَخْرُجُ فِي الصَّدَقَةِ هَرِمَةٌ وَلَا ذَاتُ عَوَارٍ وَلَا تَيْسٌ إِلَّا أَنْ يَشَاءَ الْمُصَّدِّقُ وَلَا يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلَا يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ وَإِذَا كَانَتْ سَائِمَةُ الرَّجُلِ نَاقِصَةً مِنْ أَرْبَعِينَ شَاةً شَاةً وَاحِدَةً فَلَيْسَ فِيهَا صَدَقَةٌ إِلَّا أَنْ يَشَاءَ رَبُّهَا وَفِي الرِّقَةِ رُبْعُ الْعُشْرِ فَإِذَا لَمْ يَكُنْ مَالٌ إِلَّا تِسْعِينَ وَمِئَةً فَلَيْسَ فِيهَا صَدَقَةٌ إِلَّا أَنْ يَشَاءَ رَبُّهَا»

✧ When Abu Bakr al-Siddiq was appointed caliph, he wrote this letter for him when he sent him to Yemen: 'In the name of Allah, the Most Gracious, the Most Merciful. This is the obligatory charity that the Messenger of Allah ﷺ imposed upon the Muslims, which Allah commanded His Messenger. Whoever is asked for it among the Muslims in its proper manner should give it, and whoever is asked for more than that should not give it. For twenty-four camels or less, the zakah is sheep: one sheep for every five. When they reach twenty-five to thirty-five, a one-year-old female camel (bint makhad) is due. If there is no bint makhad, then a two-year-old male camel (ibn labun). When they reach thirty-six to forty-five, a two-year-old female camel (bint labun) is due. When they reach forty-six to sixty, a three-year-old female camel (hiqqah) that can be mounted by a male camel is due. When they reach sixty-one to seventy-five, a four-year-old female camel (jadha'ah) is due. When they reach seventy-six to ninety, two bint labun are due. When they reach ninety-one to one hundred and twenty, two hiqqah are due. If they exceed one hundred and twenty, then for every forty, one bint labun, and for every fifty, one hiqqah. And whoever has camels that reach the age for jadha'ah as zakah, but he does not have a jadha'ah and has a hiqqah, the hiqqah will be accepted from him, and he should add two sheep or twenty dirhams. And whoever has camels that reach the age for hiqqah as zakah, but he does not have a hiqqah and has a jadha'ah, the jadha'ah will be accepted from him, and the collector should give him twenty dirhams or two sheep. And whoever has camels that reach the age for hiqqah as zakah, but he only has a bint labun, it will be accepted from him, and he should give two sheep or twenty dirhams. And whoever has camels that reach the age for bint labun as zakah, but he only has a hiqqah, the hiqqah will be accepted from him, and the collector should give him twenty dirhams or two sheep. And whoever has camels that reach the age for bint labun as zakah, but he does not have it, a bint makhad will be accepted from him, and he should add twenty dirhams or two sheep. And whoever has camels that reach the age for bint makhad as zakah, but he does not have it and has a bint labun, the bint labun will be accepted from him, and the collector should give him twenty dirhams or two sheep. And whoever does not have a bint makhad but has an ibn labun, it will be accepted from him, and nothing else is required. And whoever has only four camels, there is no charity on them unless their owner wishes. When they reach five camels, one sheep is due. The charity on sheep: for every forty pasturing sheep up to one hundred and twenty, one sheep is due. If they exceed one hundred and twenty up to two hundred, two sheep are due. If they exceed two hundred up to three hundred, three sheep are due. If they exceed three hundred, then for every hundred, one sheep is due. No old, defective, or male goat is to be taken as charity unless the collector wishes. Separate herds should not be combined, and combined herds should not be separated for fear of charity. If two partners have mixed livestock, they should share the charity equally between them. If a man's pasturing sheep are forty minus one, there is no charity on them unless their owner wishes. On silver, one-quarter of one-tenth is due. If there is only one hundred and ninety dirhams, there is no charity on them unless their owner wishes.'
