حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ لَيْثٍ، عَنْ أَبِي الْأَشْعَثِ، عَنْ مَوْلَاهُ قَالَ:
سَأَلْتُ عُمَرَ عَنْ رَجُلٍ أَسْلَمَ عَلَى يَدَيَّ وَعَاقَدَنِي فَمَاتَ، قَالَ: أَنْتَ أَحَقُّ النَّاسِ بِمِيرَاثِهِ مَا لَمْ يَتْرُكْ وَارِثًا، [فَإِنْ لَمْ يَتْرُكْ وَارِثًا] فَإِنْ أَبَيْتَ فَهَذَا بَيْتُ الْمَالِ
