✧ The man who falls ill and bequeaths the manumission of his slaves but does not say during this illness of mine

حَدَّثَنَا عَبْدُ الْأَعْلَى، عَنْ مَعْمَرٍ، عَنِ ابْنِ طَاوُسٍ
أَنَّ رَجُلًا مِنْ أَهْلِ الْيَمَنِ أَوْصَى فَقَالَ: فُلَانٌ حُرٌّ وَفُلَانٌ حُرٌّ - وَلَمْ يُسَمِّ - إِنْ مُتُّ فِي مَرَضِي هَذَا، فَبَرَأَ الرَّجُلُ فَخَاصَمَهُ مَمْلُوكَاهُ إِلَى قَاضِي أَهْلِ الْجَنَدِ، فَشَاوَرَ فِي ذَلِكَ طَاوُسًا، فَقَالَ طَاوُسٌ: هُمْ عَبِيدٌ، إِنَّمَا كَانَتْ نِيَّتُهُ: إِنْ حَدَثَ بِهِ حَدَثٌ
