حَدَّثَنَا هُشَيْمٌ عَنِ الشَّيْبَانِيِّ عَنِ الشَّعْبِيِّ
أَنَّهُ قَالَ فِي السَّارِقِ: إِنْ وُجِدَتِ السَّرِقَةُ عِنْدَهُ بِعَيْنِهَا أُخِذَتْ مِنْهُ وَقُطِعَتْ يَدُهُ، وَإِنْ كَانَ قَدِ اسْتَهْلَكَهَا قُطِعَتْ يَدُهُ وَلَا ضَمَانَ عَلَيْهِ
