حَدَّثَنَا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنِ الْحَارِثِ:
فِي الرَّجُلِ يَضْرِبُ الرَّجُلَ قَالَ: إِذَا شَهِدَتِ الشُّهُودُ أَنَّهُ ضَرَبَهُ فَلَمْ يَزَلْ مَرِيضًا مِنْ ضَرْبِهِ حَتَّى مَاتَ أَلْزَمْتُهُ الدِّيَةَ، فَإِنْ كَانَ عَامِدًا فَالْقَوَدُ، وَإِنْ كَانَ خَطَأً فَالدِّيَةُ عَلَى الْعَاقِلَةِ
