حَدَّثَنَا هُشَيْمٌ عَنْ يُونُسَ عَنِ الْحَسَنِ
أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً فَأَسَرَّ ذَلِكَ فَكَانَ يَخْتَلِفُ إِلَيْهَا فِي مَنْزِلِهَا، فَرَآهُ جَارٌ لَهَا يَدْخُلُ عَلَيْهَا فَقَذَفَهُ بِهَا فَخَاصَمَهُ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ، هَذَا كَانَ يَدْخُلُ عَلَى جَارَتِي وَلَا أَعْلَمُهُ تَزَوَّجَهَا، فَقَالَ لَهُ: مَا تَقُولُ ؟ فَقَالَ: تَزَوَّجْتُ امْرَأَةً عَلَى شَيْءٍ دُونٍ فَأَخْفَيْتُ ذَلِكَ، قَالَ: فَمَنْ شَهِدَكُمْ ؟ قَالَ: أَشْهَدْتُ بَعْضَ أَهْلِهَا، قَالَ: فَدَرَأَ الْحَدَّ عَنْ قَاذِفِهِ، وَقَالَ: أَعْلِنُوا هَذَا النِّكَاحَ وَحَصِّنُوا هَذِهِ الْفُرُوجَ
