مُحَمَّدُ بْنُ بَكْرٍ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ:
إِنَّ مَا يَكُونُ عَلَى الْعَيْنِ عَامَّةَ الزَّمَانِ ثُمَّ يَحْتَاجُ إِلَى الْبِئْرِ فِي الْقِطْعَةِ يُسْقَى بِهَا، ثُمَّ الْقِطْعَةِ ثُمَّ يَصِيرُ إِلَى الْعَيْنِ، كَيْفَ صَدَقَتُهُ ؟ قَالَ: الْعُشْرُ [١]، قَالَ: يَكُونُ ذَلِكَ عَلَى أَكْثَرِ ذَلِكَ إِنْ [٢]يُسْقَى بِهِ: إِنْ كَانَ يُسْقَى بِالْعَيْنِ أَكْثَرَ مِمَّا يُسْقَى بِالدَّلْوِ فَفِيهِ الْعُشْرُ، وَإِنْ كَانَ يُسْقَى بِالدَّلْوِ أَكْثَرَ مِمَّا يُسْقَى بِالنَّجْلِ [٣]فَفِيهِ نِصْفُ الْعُشْرِ. قُلْتُ: هُوَ بِمَنْزِلَةِ ذَلِكَ أَيْضًا، الْمَالُ يَكُونُ بَعْلًا أَوْ عَثَرِيًّا عَامَّةَ الزَّمَانِ ثُمَّ يَحْتَاجُ إِلَى الْبِئْرِ ؟ قَالَ: نَعَمْ

He said: "The tenth [1]." He said: "That is judged by the greater part of what it is irrigated with: if it is irrigated by the spring more than it is irrigated by the bucket, then the tenth is due on it; and if it is irrigated by the bucket more than it is irrigated by the najl [3], then half of the tenth is due on it." I said: "Is it the same in that case as well, when the crop is rain-fed (baʿl) or watered by floodwater (ʿathariyy) for most of the time, then needs the well?" He said: "Yes."
