machine translationHe said: So I came to Busrah, and she narrated to me just as Marwān had narrated to me from her, that she said: I heard the Prophet ﷺ say that.

machine translationAyyūb al-Sakhtiyānī narrated it, and Muḥammad b. ʿAbd al-Raḥmān al-Ṭufāwī, and Ḥammād b. Zayd (with disagreement about him), Yaḥyā al-Qaṭṭān, Abān b. Yazīd, ʿAlī b. al-Mubārak, Ḥammād b. Salamah (with disagreement about him), Zamʿah b. Ṣāliḥ (with disagreement about him), al-Darāwardī, Ibn Abī Ḥāzim, Abū Maʿshar Najīḥ (and it is said, from Ibn Abī Maʿshar, al-Barāʾ, which is not preserved), Maʿmar (with disagreement about him), ʿAbbād b. Ṣuhayb, Saʿīd b. ʿAbd al-Raḥmān al-Jumaḥī, Abū ʿAlqamah al-Farwī, Ḥafṣ b. Maysarah, Ḥātim b. Ismāʿīl, ʿAbd al-Ḥamīd b. Jaʿfar, Muḥammad b. Dīnār al-Ṭāḥī, and it is said from ʿAbd al-ʿAzīz b. ʿAbd al-Ṣamad: all of them from Hishām, from his father, from Busrah. Likewise ʿAbdullāh b. Buzayʿ narrated it from Hishām b. Ḥassān, from Hishām b. ʿUrwah, from his father, from Busrah. But Yazīd b. Hārūn, ʿAbd al-Aʿlā, ʿAbd al-Wahhāb al-Thaqafī, ʿAmr b. Ḥumrān and ʿUthmān b. ʿAmr contradicted him, narrating it from Hishām b. Ḥassān, from Hishām b. ʿUrwah, from his father, from Marwān, from Busrah. Likewise Ibn Ḥassāb narrated it. Khalaf b. Hishām contradicted him, from Ḥammād b. Zayd, from Hishām, and there is disagreement about him. The two Adanīs, Abū Ḥudhayfah, Yaḥyā b. Ādam, Qabīṣah and Abū Qurrah narrated it from al-Thawrī, from Hishām, from his father, from Busrah, and al-Thawrī added in it a good wording, namely his saying "until he performs his ablution for prayer." Ibn Jurayj narrated it, and Zamʿah b. Ṣāliḥ, ʿAbdullāh b. Idrīs, Ḥammād b. Salamah, Sallām b. Abī Muṭīʿ, Wuhayb b. Khālid, ʿAbd al-Raḥmān b. Abī al-Zinād, Ismāʿīl b. ʿAyyāsh, Mālik b. Anas (with disagreement about him), Shuʿayb b. Isḥāq, ʿUmar b. ʿAlī al-Muqaddamī, the son of Hishām b. ʿUrwah, Abū Usāmah (with disagreement about him), ʿAlī b. Mushir, Abū Ḍamrah Anas b. ʿIyāḍ, Maʿmar, Abū ʿAlqamah al-Farwī (with disagreement about him), Muḥammad b. Ibrāhīm b. Dīnār of the people of Medina, nicknamed Ṣandal, and Yaḥyā b. Hāshim al-Ghassānī: they narrated it from Hishām, from his father, from Marwān, from Busrah. ʿAbd al-Ḥamīd b. Jaʿfar and Muḥammad b. Dīnār al-Ṭāḥī said in this hadith: "Whoever touches his male organ, or his testicles, or his groin, let him perform ablution." Likewise said Abū Ḥumayd al-Miṣṣīṣī from Ḥajjāj, from Ibn Jurayj, from Hishām. Everyone who said this from Hishām erred in raising it to the Prophet ﷺ, because what is preserved from Hishām is what Ayyūb al-Sakhtiyānī, Mālik b. Anas and those who followed them said: that the mention of the testicles and groin is from the saying of ʿUrwah, not raised to the Prophet ﷺ nor to Busrah. Dāwūd b. ʿAbd al-Raḥmān al-ʿAṭṭār narrated it from Hishām b. ʿUrwah, from ʿAbdullāh b. Abī Bakr, from ʿUrwah, from Marwān, from Busrah. Likewise al-Bazzār said, from ʿUbayd b. Ismāʿīl al-Habbārī, from Abū Usāmah, from Hishām; but what is preserved from Abū Usāmah is from Hishām, from his father, from Marwān, from Busrah, without ʿAbdullāh b. Abī Bakr in it. So when there was disagreement about Hishām b. ʿUrwah in the chain of this hadith, a group of trustworthy, elevated narrators, among them Ayyūb al-Sakhtiyānī, Yaḥyā al-Qaṭṭān and those we mentioned with them, narrated it from Hishām, from his father, from Busrah. A group of trustworthy, elevated narrators also contradicted them, among them Sufyān al-Thawrī, Hishām b. Ḥassān, ʿAbdullāh b. Idrīs and others we mentioned with them, narrating it from Hishām, from his father, from Marwān, from Busrah. When this disagreement about Hishām arose, the matter of this hadith became problematic, and many of those who examined the disagreement thought this report was not established because of their disagreement over it, and because the ruling requires that the statement be that of whoever added to the chain, since they are trustworthy and their addition is accepted. So a group of scholars ruled the hadith weak because of their criticism of Marwān. When we looked into this and investigated it, we found a group of trustworthy memorizers, among them Shuʿayb b. Isḥāq al-Dimashqī, Rabīʿah b. ʿUthmān al-Taymī, al-Mundhir b. ʿAbdullāh al-Ḥizāmī, ʿAnbasah b. ʿAbd al-Wāḥid al-Kūfī, ʿAlī b. Mushir the Kufan judge, Ḥumayd b. al-Aswad Abū al-Aswad al-Baṣrī and Zuhayr b. Muʿāwiyah al-Juʿfī, who narrated this hadith from Hishām, from his father, from Marwān, from Busrah, and mentioned in their narration at the end of the hadith that ʿUrwah said: "Then I met Busrah afterwards and asked her about the hadith, and she narrated it to me from the Messenger of Allah ﷺ just as Marwān narrated it to me from her." This, from the narration of these people, indicates the soundness of both earlier narrations together, and the disagreement is removed, praise be to Allah, and the report is sound, and it is established that ʿUrwah heard it from Busrah directly, after Marwān had informed him from her via the policeman sent to her. What strengthens this and indicates its soundness, and that Hishām would narrate it at one time from his father, from Marwān, from Busrah, from the first hearing of ʿUrwah, and at another time from his father, from Busrah, based on ʿUrwah's meeting Busrah and hearing from her after hearing it from Marwān on her authority, is what we mentioned of the narration of Ibn Jurayj, Ḥammād b. Salamah, Zamʿah, Abū ʿAlqamah al-Farwī, Saʿīd al-Jumaḥī, Ibn Abī al-Zinād, Maʿmar and Hishām b. Ḥassān, for they narrated it from Hishām in both ways. Hishām at times, being energetic, narrated it in both ways at another time, as Shuʿayb b. Isḥāq and those who followed him narrated it.

كل من خرج في الصحيح ذكر حديث بسرة في هذا الباب وحديث طلق بن علي إلا البخاري فإنهما عنده متعارضان معلولان وعند غيره هما صحيحان والله المستعان

machine translationEveryone who compiled a Ṣaḥīḥ mentioned the hadith of Busrah on this topic and the hadith of Ṭalq b. ʿAlī, except al-Bukhārī, for in his view the two conflict and are defective (maʿlūl), while in the view of others both are sound (ṣaḥīḥ). And Allah is the one whose help is sought.

الراجح المعول عليه هو أن حديث بسرة وحديث طلق كلاهما صحيحان لكن حديثها أصح وأثبت وأرجح من حديثه كما عرفت فيما تقدم

machine translationThe preferred and relied-upon position is that the hadith of Busrah and the hadith of Ṭalq are both sound (ṣaḥīḥ), but her hadith is sounder, more established and more preponderant than his, as you learned earlier.
