✧ ‘Umar adjured the people, saying: Did any of you hear from the Prophet ﷺ about the fetus? Al-Mughirah b. Shu‘bah stood up and said: He ruled in it a male or female slave. Then he adjured the people again. The one in whose favor the ruling was made stood up and said: The Prophet ﷺ ruled for me in it a male or female slave. Then he adjured the people again. The one against whom the ruling was made stood up and said: The Prophet ﷺ ruled against me a ghurrah, a male or female slave. I said: Will you rule against me in it for what did not eat, nor drink, nor cry, nor speak? If such is to be made equal, then it is more worthy to be made equal. The Prophet ﷺ inclined to him with something he had and said: “Poetry?” ‘Umar said: Had I not learned of the ruling of the Prophet ﷺ, I would have made it a diyah between two diyahs.
