أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا الْوَلِيدُ عَنْ الْأَوْزَاعِيِّ عَنْ يَحْيَى قَالَ

«إِذَا اتَّهَمَ الْقَاضِي الْوَصِيَّ لَمْ يَعْزِلْهُ وَلَكِنْ يُوَكِّلُ مَعَهُ غَيْرَهُ» وَهُوَ رَأْيُ الْأَوْزَاعِيِّ

Translation

  4. Yaḥyá

✧ "If the judge suspects the executor, he should not remove him, but instead appoint someone else alongside him." This is the view of al-Awza'i.
