✧ In the inheritance of the cursed son.

أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلَاءِ حَدَّثَنَا يَحْيَى بْنُ أَبِي بُكَيْرٍ حَدَّثَنَا إِبْرَاهِيمُ بْنُ طَهْمَانَ عَنْ سِمَاكِ بْنِ حَرْبٍ عَنْ عِكْرِمَةَ عَنْ ابْنِ عَبَّاسٍ

أَنَّ قَوْمًا اخْتَصَمُوا إِلَى عَلِيٍّ ؓ فِي وَلَدِ الْمُتَلَاعِنَيْنِ فَجَاءَ عَصَبَةُ أَبِيهِ يَطْلُبُونَ مِيرَاثَهُ فَقَالَ «إِنَّ أَبَاهُ كَانَ تَبَرَّأَ مِنْهُ فَلَيْسَ لَكُمْ مِنْ مِيرَاثِهِ شَيْءٌ» فَقَضَى بِمِيرَاثِهِ لِأُمِّهِ وَجَعَلَهَا عَصَبَتَهُ

✧ Some people brought a dispute before ‘Alī ؓ concerning the child of two who had cursed each other (li‘ān). His father’s ‘aṣaba came seeking his inheritance. He said, “His father had disowned him, so you have no right to any of his inheritance.” He ruled that his inheritance belonged to his mother, and made her his ‘aṣaba.
