Sunan ad-Darimi 2931

✧ In my paternal cousin's sons: one of them is a husband and the other is a maternal uncle.

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ أَبِي إِسْحَاقَ عَنْ الْحَارِثِ عَنْ عَلِيٍّ

أَنَّهُ أُتِيَ فِي ابْنَيْ عَمٍّ أَحَدُهُمَا أَخٌ لِأُمٍّ فَقِيلَ لِعَلِيٍّ إِنَّ ابْنَ مَسْعُودٍ كَانَ يُعْطِيهِ الْمَالَ كُلَّهُ فَقَالَ عَلِيٌّ «إِنْ كَانَ لَفَقِيهًا وَلَوْ كُنْتُ أَنَا أَعْطَيْتُهُ السُّدُسَ وَمَا بَقِيَ كَانَ بَيْنَهُمْ»

Translation

✧ A case was brought to him concerning two paternal cousins, one of whom was a maternal brother. It was said to Ali, "Ibn Mas'ud used to give him all the wealth." Ali said, "Indeed he was a jurist. Had it been me, I would have given him the sixth and whatever remained would be between them."
