نا أَبُو الْقَاسِمِ بْنُ مَنِيعٍ نا دَاوُدُ بْنُ رُشَيْدٍ نا مُحَمَّدُ بْنُ سَلَمَةَ عَنِ الزُّبَيْرِ بْنِ خُرَيْقٍ عَنْ عَطَاءٍ

فِي رَجُلٍ قَالَ لِامْرَأَتِهِ أَنْتِ عَلَيَّ حَرَامٌ أَوْ أَنْتِ طَالِقٌ الْبَتَّةَ أَوْ أَنْتِ طَالِقٌ طَلَاقَ حَرَجٍ قَالَ أَمَّا قَوْلُهُ أَنْتِ عَلَيَّ حَرَامٌ فَيَمِينٌ يُكَفِّرُهَا وَأَمَّا قَوْلُهُ الْبَتَّةَ وَطَلَاقُ حَرَجٍ فَيَدِينُ فِيهِ

Translation

✧ Regarding a man who says to his wife: 'You are unlawful to me,' or 'You are divorced irrevocably (al-battah),' or 'You are divorced with the divorce of hardship (talaq haraj),' he said: 'As for his saying, "You are unlawful to me," it is an oath that he expiates. As for his saying "irrevocably" and "divorce of hardship," he is to be judged according to his intention (yadeenu fihi).'
