نا أَبُو بَكْرٍ النَّيْسَابُورِيُّ نا الْعَبَّاسُ بْنُ الْوَلِيدِ بْنِ مَزْيَدٍ نا عُقْبَةُ بْنُ عَلْقَمَةَ أَخْبَرَنِي مُسْلِمُ بْنُ خَالِدٍ حَدَّثَنِي جَعْفَرُ بْنُ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ حُسَيْنِ بْنِ عَلِيٍّ

أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ ؓ كَانَ يَقُولُ فِي الرَّجُلِ يَبْتَاعُ الْجَارِيَةَ فَيُصِيبُهَا ثُمَّ يَظْهَرُ عَلَى عَيْبٍ فِيهَا لَمْ يَكُنْ رَآهُ أَنَّ الْجَارِيَةَ تَلْزَمُهُ وَيُوضَعُ عَنْهُ قَدْرُ الْعَيْبِ وَقَالَ لَوْ كَانَ كَمَا يَقُولُ النَّاسُ يَرُدُّهَا وَيَرُدُّ الْعَقْرَ كَانَ ذَلِكَ شِبْهَ الْإِجَارَةِ وَكَانَ الرَّجُلُ يُصِيبُهَا وَهُوَ يَرَى الْعَيْبَ لَمْ يَرُدِ الْعَقْرَ وَلَكِنَّهُ إِذَا أَصَابَهَا لَزِمَتْهُ الْجَارِيَةُ وَوُضِعَ عَنْهُ قَدْرُ الْعَيْبِ
