A slave belonged jointly to several partners, and they sold him while one of the partners was absent. When he came back, he refused to allow the sale, so they took their dispute to Hishām b. Ismāʿīl. He ruled that the sale be annulled, that they sell him again that day, and that the yield (kharāj) be taken from him. The yield for the two years that had passed was found to be a thousand dirhams. He said: So two slaves of his were sold to cover it. He said: Then I went to ʿUrwah b. al-Zubayr and mentioned that to him, and he said: ʿĀʾishah narrated to me that the Messenger of Allah ﷺ ruled that the yield goes with liability (al-kharāju bil-ḍamān). Then ʿUrwah went to Hishām and told him that, so he reversed the sale of the two slaves and dropped the yield.
