وَحَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ، عَنْ أَبِي هُرَيْرَةَ وَزَيْدٍ، يَعْنِي ابْنَ خَالِدٍ - وَشِبْلِ بْنِ مَعْبَدٍ

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللهِ، اقْضِ بَيْنَنَا بِكِتَابِ اللهِ، فَقَالَ الْآخَرُ: وَكَانَ أَفْقَهَهُمَا أَجَلْ يَا رَسُولَ اللهِ، فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي أَنْ أَتَكَلَّمَ. قَالَ: تَكَلَّمْ. قَالَ: ابْنِي كَانَ عَسِيفًا عَلَى هَذَا، وَإِنَّهُ زَنَى بِامْرَأَةٍ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ، ثُمَّ إِنِّي سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ. فَقَالَ رَسُولُ اللهِ ﷺ: وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ، أَمَّا الْغَنَمُ وَالْجَارِيَةُ فَرَدٌّ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَاغْدُ أَنْتَ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا، فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا، فَاعْتَرَفَتْ فَرَجَمَهَا

✧ Two men brought a dispute to the Messenger of Allah ﷺ. One of them said: 'O Messenger of Allah, judge between us by the Book of Allah.' The other, who was the more learned of the two, said: 'Yes, O Messenger of Allah, judge between us by the Book of Allah and allow me to speak.' He said: 'Speak.' He said: 'My son was a laborer for this man, and he committed adultery with a woman. They told me that my son must be stoned, so I ransomed him with a hundred sheep and a slave girl. Then I asked some men of knowledge, and they told me that my son must be given a hundred lashes and exiled for a year.' The Messenger of Allah ﷺ said: 'By the One in whose hand is my soul, I will judge between you by the Book of Allah. As for the sheep and the slave girl, they are to be returned to you. Your son is to receive a hundred lashes and be exiled for a year. And you, Unays, go to this man's wife, and if she confesses, stone her.' She confessed, and he stoned her.
