حَدَّثَنَا أَبُو كَامِلٍ، قَالَ: نَا أَبُو عَوَانَةَ، عَنْ سِمَاكٍ، عَنْ حَنَشِ بْنِ الْمُعْتَمِرِ

أَنَّهُمُ احْتَفَرُوا بِئْرًا بِالْيَمَنِ، فَسَقَطَ فِيهَا الْأَسَدُ، فَأَصْبَحُوا يَنْظُرُونَ إِلَيْهِ، فَوَقَعَ رَجُلٌ فِي الْبِئْرِ، فَتَعَلَّقَ بِرَجُلٍ، فَتَعَلَّقَ الْآخَرُ بِآخَرَ، حَتَّى كَانُوا أَرْبَعَةً، فَسَقَطُوا فِي الْبِئْرِ جَمِيعًا، فَجَرَحَهُمُ الْأَسَدُ، فَتَنَاوَلَهُ رَجُلٌ بِرُمْحِهِ فَقَتَلَهُ، فَقَالَ النَّاسُ لِلْأَوَّلِ: أَنْتَ قَتَلْتَ أَصْحَابَنَا، وَعَلَيْكَ دِيَتُهُمْ، فَأَبَى أَصْحَابُهُ، فَكَادُوا يَقْتَتِلُونَ، فَقَدِمَ عَلِيٌّ عَلَى تِلْكَ الْحَالِ فَسَأَلُوهُ، فَقَالَ: سَأَقْضِي بَيْنَكُمْ بِقَضَاءٍ، فَمَنْ رَضِيَ مِنْكُمْ جَازَ عَلَيْهِ رِضَاهُ، وَمَنْ سَخِطَ فَلَا حَقَّ لَهُ حَتَّى يَأْتُوا رَسُولَ اللهِ ﷺ، فَيَقْضِيَ بَيْنَكُمْ، قَالُوا: نَعَمْ، قَالَ: اجْمَعُوا مِمَّنْ حَضَرَ الْبِئْرَ مِنَ النَّاسِ رُبُعَ دِيَةٍ، وَثُلُثَ دِيَةٍ، وَنِصْفَ دِيَةٍ، وَدِيَةً تَامَّةً، لِلْأَوَّلِ رُبُعُ دِيَةٍ مِنْ أَجْلِ أَنَّهُ هَلَكَ فَوْقَهُ ثَلَاثَةٌ، وَلِلثَّانِي ثُلُثُ دِيَةٍ؛ لِأَنَّهُ هَلَكَ فَوْقَهُ اثْنَانِ، وَلِلثَّالِثِ نِصْفُ دِيَةٍ؛ لِأَنَّهُ هَلَكَ فَوْقَهُ وَاحِدٌ، وَلِلْآخِرِ الدِّيَةُ التَّامَّةُ، فَإِنْ رَضِيتُمْ فَهَذَا بَيْنَكُمْ قَضَاءٌ، وَإِنْ لَمْ تَرْضَوْا فَلَا حَقَّ لَكُمْ حَتَّى تَأْتُوا رَسُولَ اللهِ ﷺ فَيَقْضِيَ بَيْنَكُمْ، فَأَتَوْا رَسُولَ اللهِ ﷺ الْعَامَ الْمُقْبِلَ، فَقَصُّوا عَلَيْهِ، فَقَالَ: أَنَا أَقْضِي بَيْنَكُمْ إِنْ شَاءَ اللهُ - وَهُوَ جَالِسٌ فِي مَقَامِ إِبْرَاهِيمَ ﷺ فَقَامَ رَجُلٌ، فَقَالَ: إِنَّ عَلِيًّا قَضَى بَيْنَنَا، فَقَالَ: " كَيْفَ قَضَى بَيْنَكُمْ عَلِيٌّ ؟ " فَقَصُّوا عَلَيْهِ، فَقَالَ: " هُوَ مَا قَضَى بَيْنَكُمْ

Translation

✧ They dug a well in Yemen, and a lion fell into it. In the morning they were looking at it, when a man fell into the well and grabbed hold of another man, and that one grabbed another, until there were four, and they all fell into the well together. The lion wounded them. A man struck it with his spear and killed it. The people said to the first man: You killed our companions, and their blood money is upon you. His companions refused, and they almost fought. Ali arrived at that time, so they asked him. He said: I will judge among you with a judgment; whoever among you is satisfied, his approval will be binding on him, and whoever is displeased has no claim until he comes to the Messenger of Allah ﷺ, and he judges among you. They said: Yes. He said: Collect from among the people who were present at the well a quarter of a diyah, a third of a diyah, half a diyah, and a full diyah. For the first is a quarter of a diyah because three died above him; for the second is a third of a diyah because two died above him; for the third is half a diyah because one died above him; and for the last is the full diyah. If you are satisfied, then this is a judgment among you, and if you are not satisfied, then you have no claim until you come to the Messenger of Allah ﷺ and he judges among you. The following year they came to the Messenger of Allah ﷺ and told him the story. He said: I will judge among you, if Allah wills, while he was sitting at the Station of Ibrahim ﷺ. A man stood up and said: Ali has already judged among us. He said: "How did Ali judge among you?" They told him the story, and he said: "It is as he judged among you."
