حَدَّثَنَا عَبْدُ اللهِ بْنُ شَبِيبٍ، نَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللهِ، نَا عَبْدُ الْعَزِيزِ بْنُ الْمُطَّلِبِ، عَنْ يَحْيَى بْنِ سَعِيدٍ. (م) - وَنَاهُ مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ، نَا خَالِدُ بْنُ الْحَارِثِ. نَا مُؤَمَّلُ بْنُ هِشَامٍ، نَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنِ ابْنِ عَوْنٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ

أَنَّ عُمَرَ أَتَى النَّبِيَّ ﷺ فَقَالَ: إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ ( وَقَالَ ابْنُ عَوْنٍ فِي حَدِيثِهِ: أَصَبْتُ مَالًا بِخَيْبَرَ ) مَا أَصَبْتُ مَالًا هُوَ أَنْفَسُ عِنْدِي مِنْهُ، فَقَالَ النَّبِيُّ ﷺ: إِنْ شِئْتَ تَصَدَّقْتَ بِثَمَرَتِهَا وَحَبَسْتَ أَصْلَهَا، فَتَصَدَّقَ بِهَا، لَا تُبَاعُ، وَلَا تُوهَبُ، وَلَا تُورَثُ، وَجَعَلَهَا فِي الْمَسَاكِينِ، وَابْنِ السَّبِيلِ، وَالرِّقَابِ، وَالْقَرَابَةِ، وَالضَّيْفِ، لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ، غَيْرَ مُتَأَثِّلٍ مِنْهُ

✧ That 'Umar came to the Prophet ﷺ and said: 'I have acquired land in Khaybar (and Ibn 'Awn said in his narration: I have acquired property in Khaybar); I have never acquired property more precious to me than it.' The Prophet ﷺ said: 'If you wish, you may give its fruit as charity and retain its origin.' So he gave it as charity: it is not to be sold, gifted, or inherited. He assigned it for the poor, the wayfarer, the freeing of slaves, relatives, and guests. There is no blame on the one who administers it to eat from it in a reasonable manner, without seeking wealth from it.
