( وَأَمَّا الرِّوَايَةُ ) فِيهِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ ( فَفِيمَا أَخْبَرَنَا ) أَبُو عَبْدِ اللهِ الْحَافِظُ، أَنْبَأَ أَبُو الْوَلِيدِ، ثَنَا الْحَسَنُ بْنُ سُفْيَانَ، ثَنَا أَبُو كَامِلٍ ( ح ) قَالَ أَبُو الْوَلِيدِ وَحَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدٍ قَالَ: قَالَ أَبُو عَبْدِ اللهِ، ثَنَا أَبُو كَامِلٍ وَحَامِدُ بْنُ عُمَرَ وَهَذَا حَدِيثُهُ، قَالَا: ثَنَا أَبُو عَوَانَةَ عَنْ سِمَاكٍ عَنْ حَنَشٍ قَالَ:

أُتِيَ عَلِيٌّ ؓ بِبَغْلٍ يُبَاعُ فِي السُّوقِ فَقَالَ رَجُلٌ هَذَا بَغْلِي لَمْ أَبِعْ وَلَمْ أَهَبْ وَنَزَعَ عَلَى مَا قَالَ خَمْسَةً يَشْهَدُونَ وَجَاءَ رَجُلٌ آخَرُ يَدَّعِيهِ وَيَزْعُمُ أَنَّهُ بَغْلُهُ وَجَاءَ بِشَاهِدَيْنِ فَقَالَ عَلِيٌّ ؓ: إِنَّ فِيهِ قَضَاءً وَصُلْحَةً أَمَّا الصُّلْحُ فَيُبَاعُ الْبَغْلُ فَنُقَسِّمُهُ عَلَى سَبْعَةِ أَسْهُمٍ لِهَذَا خَمْسَةٌ وَلِهَذَا اثْنَانِ فَإِنْ أَبَيْتُمْ إِلَّا الْقَضَاءَ بِالْحَقِّ فَإِنَّهُ يَحْلِفُ أَحَدُ الْخَصْمَيْنِ أَنَّهُ بَغْلُهُ مَا بَاعَهُ وَلَا وَهَبَهُ فَإِنْ تَشَاحَحْتُمَا أَيُّكُمَا يَحْلِفُ أَقْرَعْتُ بَيْنَكُمَا عَلَى الْحَلِفِ فَأَيُّكُمَا قَرَعَ حَلَفَ فَقَضَى بِهَذَا وَأَنَا شَاهِدٌ
