( أَخْبَرَنَا ) أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، ثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أَنْبَأَ الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ مَالِكُ بْنُ أَنَسٍ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ أَنَّهُ سَمِعَ أَبَا غَطَفَانَ بْنَ طَرِيفٍ الْمُرِّيَّ قَالَ:

اخْتَصَمَ زَيْدُ بْنُ ثَابِتٍ، وَابْنُ مُطِيعٍ إِلَى مَرْوَانَ بْنِ الْحَكَمِ فِي دَارٍ، فَقَضَى بِالْيَمِينِ عَلَى زَيْدِ بْنِ ثَابِتٍ عَلَى الْمِنْبَرِ فَقَالَ زَيْدٌ: أَحْلِفُ لَهُ مَكَانِي قَالَ مَرْوَانُ: لَا وَاللهِ إِلَّا عِنْدَ مَقَاطِعِ الْحُقُوقِ، فَجَعَلَ زَيْدٌ يَحْلِفُ أَنَّ حَقَّهُ لَحَقٌّ، وَيَأْبَى أَنْ يَحْلِفَ عَلَى الْمِنْبَرِ، فَجَعَلَ مَرْوَانُ يَعْجَبُ مِنْ ذَلِكَ. قَالَ مَالِكٌ: كَرِهَ زَيْدٌ صَبْرَ الْيَمِينِ
