( كَمَا أَخْبَرَنَا ) أَبُو مُحَمَّدٍ: عَبْدُ اللهِ بْنُ يَحْيَى السُّكَّرِيُّ بِبَغْدَادَ، أَنْبَأَ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثَنَا أَحْمَدُ بْنُ مَنْصُورٍ الرَّمَادِيُّ، ثَنَا عَبْدُ الرَّزَّاقِ، ( ح ) وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أَنْبَأَ أَبُو بَكْرِ بْنُ دَاسَةَ، ثَنَا أَبُو دَاوُدَ، ثَنَا أَحْمَدُ بْنُ صَالِحٍ، ثَنَا عَبْدُ الرَّزَّاقِ، أَنْبَأَ مَعْمَرٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ، عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ:
أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي رَجُلٍ وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ. وَفِي رِوَايَةِ الرَّمَادِيِّ قَضَى فِي الرَّجُلِ يُصِيبُ جَارِيَةَ امْرَأَتِهِ: إِنِ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا، وَإِنْ طَاوَعَتْهُ فَهِيَ لَهُ، وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا
