( أَخْبَرَنَا ) أَبُو الْحَسَنِ الرَّفَّاءُ الْبَغْدَادِيُّ، أَنْبَأَ عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثَنَا إِسْمَاعِيلُ الْقَاضِي، ثَنَا إِسْمَاعِيلُ بْنُ أَبِي أُوَيْسٍ، ثَنَا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ:
مَنْ تَزَوَّجَ مِمَّنْ لَمْ يَكُنْ أُحْصِنَ قَبْلَ ذَلِكَ فَزَنَى قَبْلَ أَنْ يَدْخُلَ بِامْرَأَتِهِ، فَلَا رَجْمَ عَلَيْهِ، وَالْمَرْأَةُ مِثْلُ ذَلِكَ. فَإِنْ دَخَلَ بِامْرَأَتِهِ سَاعَةً مِنْ لَيْلٍ أَوْ نَهَارٍ، أَوْ أَكْثَرَ فَزَنَى بَعْدَ ذَلِكَ فَعَلَيْهِ الرَّجْمُ، وَالْمَرْأَةُ مِثْلُ ذَلِكَ، وَالْإِمَاءُ أُمَّهَاتُ الْأَوْلَادِ لَا يُوجِبْنَ الرَّجْمَ
