( وَأَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثَنَا أَبُو الْعَبَّاسِ الْأَصَمُّ، أَنْبَأَ الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ:
قَضَى عُمَرُ بْنُ الْخَطَّابِ ؓ فِي الْأَضْرَاسِ بِبَعِيرٍ بَعِيرٍ وَقَضَى مُعَاوِيَةُ فِي الْأَضْرَاسِ بِخَمْسَةِ أَبْعِرَةٍ خَمْسَةِ أَبْعِرَةٍ؛ فَالدِّيَةُ تَنْقُصُ فِي قَضَاءِ عُمَرَ ؓ وَتَزِيدُ فِي قَضَاءِ مُعَاوِيَةَ ؓ فَلَوْ كُنْتُ أَنَا جَعَلْتُ فِي الْأَضْرَاسِ بَعِيرَيْنِ بَعِيرَيْنِ، فَتِلْكَ الدِّيَةُ سَوَاءٌ.
