( أَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثَنَا أَبُو الْعَبَّاسِ الْأَصَمُّ، ثَنَا الرَّبِيعُ قَالَ: قَالَ الشَّافِعِيُّ: قَالَ حَمَّادٌ، عَنْ قَتَادَةَ، عَنْ خِلَاسٍ، عَنْ عَلِيٍّ ؓ قَالَ:
إِذَا أَمَرَ الرَّجُلُ عَبْدَهُ أَنْ يَقْتُلَ رَجُلًا فَإِنَّمَا هُوَ كَسَيْفِهِ أَوْ كَسَوْطِهِ يُقْتَلُ الْمَوْلَى وَيُحْبَسُ الْعَبْدُ فِي السِّجْنِ
