فَالْأُمُّ أَحَقُّ بِوَلَدِهَا مَا لَمْ تَتَزَوَّجْ وَكَانُوا صِغَارًا فَإِذَا بَلَغَ أَحَدُهُمْ سَبْعَ أَوْ ثَمَانِ سِنِينَ وَهُوَ يَعْقِلُ خُيِّرَ بَيْنَ أَبِيهِ وَأُمِّهِ، وَكَانَ عِنْدَ أَيِّهِمَا اخْتَارَ. ( 15858 - أَخْبَرَنَا ) أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا: ثَنَا أَبُو الْعَبَّاسِ الْأَصَمُّ، أَنْبَأَ الرَّبِيعُ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ ابْنُ عُيَيْنَةَ، عَنْ زِيَادِ بْنِ سَعْدٍ قَالَ: أَبُو مُحَمَّدٍ أَظُنُّهُ عَنْ هِلَالِ بْنِ أَبِي مَيْمُونَةَ، عَنْ أَبِي مَيْمُونَةَ، عَنْ أَبِي هُرَيْرَةَ
