When a man marries a woman who is a virgin, she is entitled to seven nights, then he divides his time equally; and when he marries her as a previously married woman (thayyib), she is entitled to three days, then he divides his time equally.

  • Dāraquṭnī

machine translationThere is disagreement about it regarding Ḥumayd. Ibn Wahb narrated it outside the Muwaṭṭaʾ from Mālik and al-ʿUmarī, from Ḥumayd, from Anas, as raised to the Prophet (marfūʿ). He narrated it in the Muwaṭṭaʾ as a statement of the Companion (mawqūf) from Mālik alone, and likewise the transmitters of the Muwaṭṭaʾ narrated it as mawqūf. ʿAbd al-Jabbār b. al-ʿAlāʾ narrated it from Ibn ʿUyaynah, from Ḥumayd, from Anas, as marfūʿ, but others do not raise it from Ibn ʿUyaynah. The sound (ṣaḥīḥ) position is that it is a statement of Anas, and ʿAbdullāh b. ʿUmar al-ʿUmarī traced it back with a connected chain (asnadahu) from Ḥumayd, from Anas.
