وَأَخْبَرَنَا ) أَبُو عَبْدِ اللهِ الْحَافِظُ، ثَنَا أَبُو الْعَبَّاسِ، ثَنَا يَحْيَى، أَنَا يَزِيدُ، أَنَا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ:
امْرَأَةٌ تَرَكَتِ ابْنَيْ عَمِّهَا أَحَدُهُمَا زَوْجُهَا، وَالْآخَرُ أَخُوهَا لِأُمِّهَا، فِي قَوْلِ عَلِيٍّ وَزَيْدٍ - ؓ: لِلزَّوْجِ النِّصْفُ، وَلِلْأَخِ مِنَ الْأُمِّ السُّدُسُ، وَهُمَا شَرِيكَانِ فِيمَا بَقِيَ، وَفِي قَوْلِ عَبْدِ اللهِ: لِلزَّوْجِ النِّصْفُ، وَلِلْأَخِ مِنَ الْأُمِّ مَا بَقِيَ. قَالَ يَزِيدُ: بِقَوْلِ عَلِيٍّ وَزَيْدٍ ؓ يُؤْخَذُ
