وَرَوَاهُ يَحْيَى بْنُ سُلَيْمٍ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ عَنْ بَعْضِ بَنِي عَبْدِ اللهِ بْنِ مَسْعُودٍ عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ:
إِذَا اخْتَلَفَ الْمُتَبَايِعَانِ وَلَيْسَ بَيْنَهُمَا شَاهِدٌ اسْتُحْلِفَ الْبَائِعُ، ثُمَّ كَانَ الْمُبْتَاعُ بِالْخِيَارِ، إِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ
