( أَخْبَرَنَا ) أَبُو عَبْدِ اللهِ الْحَافِظُ فِي آخَرِينَ قَالُوا: ثَنَا أَبُو الْعَبَّاسِ، أَنَا الرَّبِيعُ، أَنَا الشَّافِعِيُّ، أَنَا مَالِكٌ، ( ح ) وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثَنَا عَلِيُّ بْنُ عِيسَى بْنِ إِبْرَاهِيمَ الْحِيرِيُّ، ثَنَا مُحَمَّدُ بْنُ عَمْرٍو وَإِبْرَاهِيمُ بْنُ عَلِيٍّ وَمُوسَى بْنُ مُحَمَّدٍ قَالُوا: ثَنَا يَحْيَى بْنُ يَحْيَى قَالَ: قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ:
مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
