حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ قَالَ حَدَّثَنَا مُجَالِدٌ حَدَّثَنَا عَامِرٍ قَالَ قَدِمْتُ الْمَدِينَةَ فَأَتَيْتُ فَاطِمَةَ بِنْتَ قَيْسٍ فَحَدَّثَتْنِي
أَنَّ زَوْجَهَا طَلَّقَهَا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ، فَبَعَثَهُ رَسُولُ اللهِ ﷺ فِي سَرِيَّةٍ، فَقَالَ لِي أَخُوهُ: اخْرُجِي مِنَ الدَّارِ. فَقُلْتُ: إِنَّ لِي نَفَقَةً وَسُكْنَى حَتَّى يَحِلَّ الْأَجَلُ. قَالَ: لَا. قَالَتْ: فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ: إِنَّ فُلَانًا طَلَّقَنِي، وَإِنَّ أَخَاهُ أَخْرَجَنِي وَمَنَعَنِي السُّكْنَى وَالنَّفَقَةَ. فَأَرْسَلَ إِلَيْهِ فَقَالَ: مَا لَكَ وَلِابْنَةِ آلِ قَيْسٍ ؟ قَالَ: يَا رَسُولَ اللهِ، إِنَّ أَخِي طَلَّقَهَا ثَلَاثًا جَمِيعًا. قَالَتْ: فَقَالَ لِي رَسُولُ اللهِ ﷺ: انْظُرِي يَا بِنْتَ آلِ قَيْسٍ، إِنَّمَا النَّفَقَةُ وَالسُّكْنَى لِلْمَرْأَةِ عَلَى زَوْجِهَا مَا كَانَتْ لَهُ عَلَيْهَا رَجْعَةٌ، فَإِذَا لَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ فَلَا نَفَقَةَ وَلَا سُكْنَى. اخْرُجِي فَانْزِلِي عَلَى فُلَانَةَ. ثُمَّ قَالَ: إِنَّهَا يُتَحَدَّثُ إِلَيْهَا، انْزِلِي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ؛ فَإِنَّهُ أَعْمَى لَا يَرَاكِ. ثُمَّ قَالَ: لَا تَنْكِحِي حَتَّى أَكُونَ أَنَا أُنْكِحُكِ. قَالَتْ: فَخَطَبَنِي رَجُلٌ مِنْ قُرَيْشٍ، فَأَتَيْتُ رَسُولَ اللهِ ﷺ أَسْتَأْمِرُهُ، فَقَالَ: أَلَا تَنْكِحِينَ مَنْ هُوَ أَحَبُّ إِلَيَّ مِنْهُ ؟ فَقُلْتُ: بَلَى. يَا رَسُولَ اللهِ، فَأَنْكِحْنِي مَنْ أَحْبَبْتَ. قَالَتْ: فَأَنْكَحَنِي مِنْ أُسَامَةَ بْنِ زَيْدٍ

✧ Her husband divorced her during the time of the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ sent him on a military expedition. His brother said to me: Leave the house. I said: I am entitled to maintenance and residence until the term ends. He said: No. She said: I came to the Messenger of Allah ﷺ and said: So-and-so divorced me, and his brother has made me leave and prevented me from residence and maintenance. He sent for him and said: What do you have to do with the daughter of the family of Qays? He said: O Messenger of Allah, my brother divorced her three times all at once. She said: The Messenger of Allah ﷺ said to me: Look, daughter of the family of Qays. Maintenance and residence are only for a woman whose husband may take her back. If he has no right to take her back, then there is no maintenance or residence. Leave and stay with so-and-so. Then he said: People talk to her; stay with Ibn Umm Maktum, for he is blind and will not see you. Then he said: Do not marry until I myself arrange your marriage. She said: A man from Quraysh proposed to me, and I came to the Messenger of Allah ﷺ to consult him. He said: Will you not marry one who is dearer to me than him? I said: Yes, O Messenger of Allah, marry me to whomever you love. She said: So he married me to Usamah b. Zayd.
