حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الرَّازِيُّ قَالَ حَدَّثَنَا سَلَمَةُ بْنُ الْفَضْلِ قَالَ حَدَّثَنِي مُحَمَّدُ بْنُ إِسْحَاقَ عَنِ الْخَطَّابِ بْنِ صَالِحٍ عَنْ أُمِّهِ قَالَتْ حَدَّثَتْنِي سَلَامَةُ بِنْتُ مَعْقِلٍ قَالَتْ
كُنْتُ لِلْحُبَابِ بْنِ عَمْرٍو وَلِي مِنْهُ غُلَامٌ، فَقَالَتْ لِي امْرَأَتُهُ: الْآنَ تُبَاعِينَ فِي دَيْنِهِ. فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ، فَقَالَ رَسُولُ اللهِ ﷺ: مَنْ صَاحِبُ تَرِكَةِ الْحُبَابِ بْنِ عَمْرٍو ؟ فَقَالُوا: أَخُوهُ أَبُو الْيَسَرِ كَعْبُ بْنُ عَمْرٍو. فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ: لَا تَبِيعُوهَا وَأَعْتِقُوهَا، فَإِذَا سَمِعْتُمْ بِرَقِيقٍ قَدْ جَاءَنِي فَأْتُونِي أُعَوِّضْكُمْ. فَفَعَلُوا فَاخْتَلَفُوا فِيمَا بَيْنَهُمْ بَعْدَ وَفَاةِ رَسُولِ اللهِ ﷺ فَقَالَ قَوْمٌ: أُمُّ الْوَلَدِ مَمْلُوكَةٌ، لَوْلَا ذَلِكَ لَمْ يُعَوِّضْهُمْ رَسُولُ اللهِ ﷺ مِنْهَا، وَقَالَ بَعْضُهُمْ: هِيَ حُرَّةٌ قَدْ أَعْتَقَهَا رَسُولُ اللهِ ﷺ فَفِيَّ كَانَ الِاخْتِلَافُ
Translation

✧ I was a slave woman belonging to al-Hubab b. ʿAmr, and I had a son from him. His wife said to me, "Now you will be sold to pay his debt." So I went to the Messenger of God ﷺ and mentioned that to him. The Messenger of God ﷺ said, "Who is in charge of the estate of al-Hubab b. ʿAmr?" They said, "His brother Abu al-Yasar Kaʿb b. ʿAmr." The Messenger of God ﷺ called him and said, "Do not sell her; set her free. When you hear of slaves coming to me, come to me and I will compensate you." They did so, but they differed among themselves after the death of the Messenger of God ﷺ. Some said, "An umm walad is a slave; otherwise the Messenger of God ﷺ would not have compensated them for her." Others said, "She is free; the Messenger of God ﷺ set her free." Thus the disagreement was concerning me.
