حَدَّثَنَا عَفَّانُ أَخْبَرَنَا جَرِيرُ بْنُ حَازِمٍ أَخْبَرَنَا قَيْسُ بْنُ سَعْدٍ عَنْ يَزِيدَ بْنِ هُرْمُزَ قَالَ كَتَبَ نَجْدَةُ بْنُ عَامِرٍ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنِ أشْيَاءَ فَشَهِدْتُ ابْنَ عَبَّاسٍ حِينَ قَرَأَ كِتَابَهُ وَحِينَ كَتَبَ جَوَابَهُ فَقَالَ ابْنُ عَبَّاسٍ وَاللهِ لَوْلَا أَنْ أَرُدَّهُ

كَتَبَ نَجْدَةُ بْنُ عَامِرٍ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ أَشْيَاءَ، فَشَهِدْتُ ابْنَ عَبَّاسٍ حِينَ قَرَأَ كِتَابَهُ، وَحِينَ كَتَبَ جَوَابَهُ، فَقَالَ ابْنُ عَبَّاسٍ: وَاللهِ لَوْلَا أَرُدَّهُ عَنْ شَرٍّ يَقَعُ فِيهِ مَا كَتَبْتُ إِلَيْهِ وَلَا نُعْمَةَ عَيْنٍ ! قَالَ: فَكَتَبَ إِلَيْهِ: إِنَّكَ سَأَلْتَنِي عَنْ سَهْمِ ذَوِي الْقُرْبَى الَّذِي ذَكَرَ اللهُ عَزَّ وَجَلَّ مَنْ هُمْ ؟ وَإِنَّا كُنَّا نَرَى أَنَّ قَرَابَةَ رَسُولِ اللهِ ﷺ هُمْ، فَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا. وَسَأَلَهُ عَنِ الْيَتِيمِ مَتَى يَنْقَضِي يُتْمُهُ ؟ وَأَنَّهُ إِذَا بَلَغَ النِّكَاحَ وَأُونِسَ مِنْهُ رُشْدٌ دُفِعَ إِلَيْهِ مَالُهُ، وَقَدِ انْقَضَى يُتْمُهُ. وَسَأَلَهُ: هَلْ كَانَ رَسُولُ اللهِ ﷺ يَقْتُلُ مِنْ صِبْيَانِ الْمُشْرِكِينَ أَحَدًا ؟ فَقَالَ: إِنَّ رَسُولَ اللهِ ﷺ لَمْ يَقْتُلْ مِنْهُمْ أَحَدًا، وَأَنْتَ فَلَا تَقْتُلْ إِلَّا أَنْ تَكُونَ تَعْلَمُ مَا عَلِمَ الْخَضِرُ مِنَ الْغُلَامِ الَّذِي قَتَلَهُ. وَسَأَلَهُ عَنِ الْمَرْأَةِ وَالْعَبْدِ هَلْ كَانَ لَهُمَا سَهْمٌ مَعْلُومٌ إِذَا حَضَرُوا الْبَأْسَ ؟ وَأَنَّهُ لَمْ يَكُنْ لَهُمْ سَهْمٌ مَعْلُومٌ إِلَّا أَنْ يُحْذَيَا مِنْ غَنَائِمِ الْمُسْلِمِينَ

✧ Najdah b. ʿĀmir wrote to Ibn ʿAbbās asking him about several matters. I witnessed Ibn ʿAbbās when he read his letter and when he wrote his reply. Ibn ʿAbbās said: By Allah, were it not to turn him away from an evil he would fall into, I would not write to him, nor would he deserve any favor. He wrote to him: You asked me about the share of the near relatives which Allah, Mighty and Majestic, mentioned—who are they? We used to think that the relatives of the Messenger of Allah ﷺ were those meant, but our people refused that to us. He asked him about the orphan: when does his orphanhood end? When he reaches marriageable age and sound judgment is observed in him, his property is handed over to him, and his orphanhood has ended. He asked him: Did the Messenger of Allah ﷺ ever kill any of the children of the polytheists? He said: The Messenger of Allah ﷺ did not kill any of them, and you should not kill any, unless you know what al-Khaḍir knew about the boy he killed. He asked him about the woman and the slave: did they have a fixed share when they attended battle? There was no fixed share for them, except that they might be given something from the Muslims' spoils.
