حَدَّثَنَا أَبُو دَاوُدَ الْحَفَرِيُّ حَدَّثَنَا سُفْيَانُ عَنْ قَيْسِ بْنِ مُسْلِمٍ عَنْ طَارِقِ بْنِ شِهَابٍ قَالَ قَالَ أَبُو مُوسَى
قَدِمْتُ مِنَ الْيَمَنِ قَالَ: فَقَالَ لِيَ النَّبِيُّ ﷺ: بِمَ أَهْلَلْتَ ؟ قَالَ: قُلْتُ: بِإِهْلَالٍ كَإِهْلَالِ النَّبِيِّ ﷺ قَالَ: فَقَالَ: هَلْ مَعَكَ مِنْ هَدْيٍ ؟ قَالَ: قُلْتُ يَعْنِي: لَا. قَالَ: فَأَمَرَنِي فَطُفْتُ بِالْبَيْتِ، وَبَيْنَ الصَّفَا وَالْمَرْوَةِ، ثُمَّ أَتَيْتُ امْرَأَةً مِنْ قَوْمِي فَمَشَطَتْ رَأْسِي وَغَسَلَتْهُ، ثُمَّ أَحْلَلْتُ، فَلَمَّا كَانَ يَوْمُ التَّرْوِيَةِ أَهْلَلْتُ بِالْحَجِّ قَالَ: فَكُنْتُ أُفْتِي النَّاسَ بِذَلِكَ إِمَارَةَ أَبِي بَكْرٍ وَعُمَرَ ؓ، فَبَيْنَا أَنَا وَاقِفٌ فِي سُوقِ الْمَوْسِمِ إِذْ جَاءَ رَجُلٌ فَسَارَّنِي، فَقَالَ: إِنَّكَ لَا تَدْرِي مَا أَحْدَثَ أَمِيرُ الْمُؤْمِنِينَ فِي شَأْنِ النُّسُكِ، قَالَ: قُلْتُ: أَيُّهَا النَّاسُ مَنْ كُنَّا أَفْتَيْنَاهُ فِي شَيْءٍ فَلْيَتَّئِدْ، فَهَذَا أَمِيرُ الْمُؤْمِنِينَ قَادِمٌ عَلَيْكُمْ فَبِهِ فَأْتَمُّوا، قَالَ: فَقَالَ لِي: إِنْ نَأْخُذْ بِكِتَابِ اللهِ تَعَالَى، فَإِنَّهُ يَأْمُرُ بِالتَّمَامِ، وَإِنْ نَأْخُذْ بِسُنَّةِ نَبِيِّنَا ﷺ فَإِنَّهُ لَمْ يَحِلَّ حَتَّى نَحَرَ الْهَدْيَ

✧ I arrived from Yemen. The Prophet ﷺ said to me: With what did you enter ihram? He said: I said: With an ihram like the ihram of the Prophet ﷺ. He said: Do you have any sacrificial animal with you? He said: I said, meaning: No. He said: So he ordered me, and I circumambulated the House and went between Safa and Marwah, then I came to a woman of my people who combed my hair and washed it, and then I exited ihram. When the Day of Tarwiyah came, I entered ihram for the Hajj. He said: I used to give fatwa to the people about this during the caliphate of Abu Bakr and Umar ؓ. While I was standing in the market of the season, a man came and whispered to me, saying: You do not know what the Commander of the Faithful has introduced regarding the rites. He said: I said: O people, whoever we have given a fatwa to about something, let him wait, for this is the Commander of the Faithful coming to you, so follow him. He said: He said to me: If we take the Book of God Almighty, it commands completion; and if we take the Sunnah of our Prophet ﷺ, he did not exit ihram until he had slaughtered the sacrificial animal.
