حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ قَالَ حَدَّثَنَا عِكْرِمَةُ عَنْ أَبِي النَّجَاشِيِّ مَوْلَى رَافِعِ بْنِ خَدِيجٍ قَالَ
سَأَلْتُ رَافِعًا عَنْ كِرَاءِ الْأَرْضِ. قُلْتُ: إِنَّ لِي أَرْضًا أُكْرِيهَا ؟ فَقَالَ رَافِعٌ: لَا تُكْرِهَا بِشَيْءٍ، فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ: مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا، فَإِنْ لَمْ يَزْرَعْهَا فَلْيُزْرِعْهَا أَخَاهُ، فَإِنْ لَمْ يَفْعَلْ فَلْيَدَعْهَا، فَقُلْتُ لَهُ: أَرَأَيْتَ إِنْ تَرَكْتُهُ وَأَرْضِي، فَإِنْ زَرَعَهَا ثُمَّ بَعَثَ إِلَيَّ مِنَ التِّبْنِ ؟ قَالَ: لَا تَأْخُذْ مِنْهَا شَيْئًا وَلَا تِبْنًا، قُلْتُ: إِنِّي لَمْ أُشَارِطْهُ إِنَّمَا أَهْدَى إِلَيَّ شَيْئًا ؟ قَالَ: لَا تَأْخُذْ مِنْهُ شَيْئًا

✧ I asked Rafi about leasing land. I said: I have land that I lease out. Rafi said: Do not lease it for anything, for I heard the Messenger of God ﷺ say: Whoever has land, let him cultivate it; if he does not cultivate it, let him have his brother cultivate it; if he does not do that, let him leave it. I said to him: What do you think if I leave it and my land, and then he cultivates it and sends me some straw? He said: Do not take anything from it, not even straw. I said: I did not stipulate with him; he only gave me something as a gift. He said: Do not take anything from him.
