حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ قَالَ أَخْبَرَنَا سُفْيَانُ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ قَالَ

أُتِيَ عَبْدُ اللهِ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ، ثُمَّ مَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا، وَلَمْ يَكُنْ دَخَلَ بِهَا- قَالَ: فَاخْتَلَفُوا إِلَيْهِ فَقَالَ: أَرَى لَهَا مِثْلَ صَدَاقِ نِسَائِهَا وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ، فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ، أَنَّ النَّبِيَّ ﷺ قَضَى فِي بَرْوَعَ ابْنَةِ وَاشِقٍ بِمِثْلِ مَا قَضَى.

✧ Abdullah was consulted about a woman whom a man married, then he died leaving her without having assigned a dower for her, and he had not consummated the marriage with her. He said: They kept coming to him with differing opinions, so he said: I am of the view that she is entitled to a dower like that of women of her standing, and she inherits, and she must observe the waiting period. Ma'qil b. Sinan al-Ashja'i testified that the Prophet ﷺ ruled concerning Barwa' bint Washiq exactly as he ruled.
