✧ Two Christians embrace Islam and have young children

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ: سَمِعْتُ سُلَيْمَانَ بْنَ مُوسَى يُخْبِرُ عَطَاءً قَالَ:
الْأَمْرُ فِي مَا مَضَى فِي أَوَّلِنَا، الَّذِي يُعْمَلُ بِهِ، وَلَا يُشَكُّ فِيهِ، وَنَحْنُ عَلَيْهِ الْآنَ أَنَّ النَّصْرَانِيَّيْنِ بَيْنَهُمَا وَلَدُهُمَا صَغِيرٌ، يَرِثَانِهِ وَيَرِثُهُمَا، حَتَّى يُفَرِّقَ بَيْنَهُمَا دِينٌ أَوْ يَجْمَعَ. فَإِنْ أَسْلَمَتْ أُمُّهُ وَرِثَتْهُ، كِتَابَ اللهِ، وَمَا بَقِيَ لِلْمُسْلِمِينَ. وَإِنْ كَانَ أَبُوهُ نَصْرَانِيًّا وَهُوَ صَغِيرٌ، وَلَهُ أَخٌ مِنْ أُمِّهِ مُسْلِمٌ، أَوْ أُخْتٌ مُسْلِمَةٌ، وَرِثَهُ أَخُوهُ، أَوْ أُخْتُهُ، كِتَابَ اللهِ، ثُمَّ كَانَ مَا بَقِيَ لِلْمُسْلِمِينَ. قَالَ: وَلَا يُصَلَّى عَلَى أَبْنَاءِ النَّصْرَانِيِّ، وَلَا نُعَزِّيهِ فِيهِمْ، وَلَا يَتَّبِعُوهُمْ إِلَى قُبُورِهِمْ، وَيَدْفِنُوهُمْ فِي مَقْبَرَتِهِمْ، قَالَ: وَإِنْ قَتَلَ مُسْلِمٌ مِنْ أَبْنَائِهِمْ عَمْدًا لَمْ يُقْتَلْ بِهِ، وَكَانَ دِيَتُهُ دِيَةَ نَصْرَانِيٍّ ". قُلْتُ لِسُلَيْمَانَ: فَوَلَدٌ صَغِيرٌ بَيْنَ مُشْرِكَيْنِ، فَأَسْلَمَ أَحَدُهُمَا، وَوَلَدُهُمَا صَغِيرٌ، فَمَاتَ أَبُوهُمْ قَالَ: " يَرِثُ وَلَدُهُمَا الْمُسْلِمَ مِنْ أَبَوَيْهِ، وَلَا يَرِثُ الْكَافِرُ مِنْهُمَا، الْوِرَاثَةُ حِينَئِذٍ بَيْنَ الْمُسْلِمِ وَبَيْنَ الْوَلَدِ، وَلَا يَرِثُ الْوَلَدُ حِينَئِذٍ الْكَافِرَ مِنْ أَبَوَيْهِ
Translation
✧ The established practice among our predecessors, which is acted upon and not doubted, and upon which we are now, is that two Christians who have their young child between them inherit from him, and he inherits from them, until a religion either separates them or unites them. If his mother embraces Islam, she inherits from him according to the Book of God, and what remains goes to the Muslims. If his father is a Christian while he is young, and he has a maternal brother who is Muslim or a maternal sister who is Muslim, his brother or sister inherits from him according to the Book of God, and then what remains goes to the Muslims. He said: Funeral prayer is not performed over the children of a Christian, nor do we console him for them, nor do they follow them to their graves; they bury them in their own cemetery. He said: If a Muslim kills one of their children intentionally, he is not executed for it, and his blood money is the blood money of a Christian. I said to Sulayman: What about a young child between two polytheists, when one of them embraces Islam while their child is young, and then their father dies? He said: Their child inherits from the Muslim parent, and the disbelieving parent does not inherit from either of them. At that point, the inheritance is between the Muslim and the child, and the child does not then inherit from the disbelieving parent.
