عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ، وَإِسْمَاعِيلَ بْنِ أُمَيَّةَ،
أَنَّ نَجْدَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ سَهْمِ ذِي الْقُرْبَى، وَعَنْ قَتْلِ الصِّبْيَانِ، وَعَنِ الْعَبِيدِ: هَلْ كَانُوا يُعْطَوْنَ مِنَ الْغَنَائِمِ شَيْئًا ؟ فَكَتَبَ إِلَيْهِ ابْنُ عَبَّاسٍ: كَتَبْتَ لِي فِي سَهْمِ ذِي الْقُرْبَى، فَإِنَّهُ كَانَ لَنَا حَتَّى حَرَمْنَاهُ قَوْمَنَا، وَكَتَبْتَ فِي قَتْلِ الصِّبْيَانِ، فَإِنْ كُنْتَ تَعْلَمُ مِنْهُمْ مَا كَانَ صَاحِبُ مُوسَى يَعْلَمُ، وَإِلَّا لَا يَحِلُّ لَكَ قَتْلُهُمْ، وَكَتَبْتَ فِي الْعَبِيدِ هَلْ كَانُوا يُعْطَوْنَ مِنَ الْغَنَائِمِ شَيْئًا، وَإِنَّهُمْ كَانُوا يُحْذَوْنَ الشَّيْءَ مِنْ غَيْرِ أَنْ يُضْرَبَ لَهُمْ سَهْمٌ
Translation
✧ That Najdah wrote to Ibn Abbas asking him about the share of the near relatives, about killing children, and about slaves: were they given anything from the spoils? Ibn Abbas wrote back to him: "You wrote to me about the share of the near relatives. It was ours until our people deprived us of it. You wrote about killing children. If you know about them what the companion of Musa knew, then otherwise it is not lawful for you to kill them. You wrote about slaves, whether they were given anything from the spoils. They used to be given small gifts without any share being allotted for them."
