✧ Protection and the protection granted by a slave and a woman

عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ عَاصِمِ بْنِ سُلَيْمَانَ، عَنْ فُضَيْلٍ الرَّقَاشِيِّ قَالَ:
شَهِدْتُ قَرْيَةً مِنْ قُرَى فَارِسَ يُقَالُ لَهَا شَاهِرْتَا فَحَاصَرْنَاهَا شَهْرًا، حَتَّى إِذَا كَانَ ذَاتَ يَوْمٍ وَطَمِعْنَا أَنْ نُصَبِّحَهُمُ، انْصَرَفْنَا عَنْهُمْ عِنْدَ الْمَقِيلِ، فَتَخَلَّفَ عَبْدٌ مِنَّا فَاسْتَأْمَنُوهُ، فَكَتَبَ إِلَيْهِمْ فِي سَهْمٍ أَمَانًا، ثُمَّ رَمَى بِهِ إِلَيْهِمْ، فَلَمَّا رَجَعْنَا إِلَيْهِمْ خَرَجُوا فِي ثِيَابِهِمْ، وَوَضَعُوا أَسْلِحَتَهُمْ فَقُلْنَا: مَا شَأْنُكُمْ ؟ فَقَالُوا: أَمَّنْتُمُونَا وَأَخْرَجُوا إِلَيْنَا السَّهْمَ فِيهِ كِتَابُ أَمَانِهِمْ فَقُلْنَا: هَذَا عَبْدٌ وَالْعَبْدُ لَا يَقْدِرُ عَلَى شَيْءٍ، قَالُوا: لَا نَدْرِي عَبْدَكُمْ مِنْ حُرِّكُمْ، وَقَدْ خَرَجُوا بِأَمَانٍ، قُلْنَا: فَارْجِعُوا بِأَمَانٍ، قَالُوا: لَا نَرْجِعُ إِلَيْهِ أَبَدًا، فَكَتَبْنَا إِلَى عُمَرَ بَعْضَ قِصَّتِهِمْ، فَكَتَبَ عُمَرُ: أَنَّ الْعَبْدَ الْمُسْلِمَ مِنَ الْمُسْلِمِينَ أَمَانُهُ أَمَانُهُمْ قَالَ: فَفَاتَنَا مَا كُنَّا أَشْرَفْنَا عَلَيْهِ مِنْ غَنَائِمِهِمْ
Translation
✧ I witnessed a town of the towns of Persia called Shahirta, and we besieged it for a month, until one day when we hoped to attack them in the morning, we withdrew from them at the time of the midday rest. A slave of ours remained behind, and they asked him for protection. He wrote to them on an arrow a letter of protection, then shot it to them. When we returned to them, they came out in their clothes and laid down their weapons. We said, 'What is your matter?' They said, 'You granted us protection,' and they brought out to us the arrow containing the letter of their protection. We said, 'This is a slave, and a slave has no power over anything.' They said, 'We do not know your slave from your free man, and they have come out under protection.' We said, 'Then return under protection.' They said, 'We will never return to it.' So we wrote to Umar part of their story, and Umar wrote: 'The Muslim slave is from the Muslims; his protection is their protection.' He said: 'Thus we missed what we had been on the verge of from their spoils.'
