عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، وَمَعْمَرٍ، عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ، عَنْ سُلَيْمَانَ بْنِ بُرَيْدَةَ الْأَسْلَمِيِّ، عَنْ أَبِيهِ قَالَ:
كَانَ رَسُولُ اللهِ ﷺ إِذَا أَمَّرَ أَمِيرًا عَلَى جَيْشٍ أَوْ سَرِيَّةٍ أَوْصَاهُ فِي خَاصَّةِ نَفْسِهِ بِتَقْوَى اللهِ، وَبِمَنْ مَعَهُ مِنَ الْمُسْلِمِينَ خَيْرًا ثُمَّ قَالَ: اغْزُوا بِسْمِ اللهِ فِي سَبِيلِ اللهِ، فَقَاتِلُوا مَنْ كَفَرَ بِاللهِ، اغْزُوا وَلَا تَغْدِرُوا، وَلَا تُمَثِّلُوا، وَلَا تَغُلُّوا، وَلَا تَقْتُلُوا وَلِيدًا، إِذَا أَنْتَ لَقِيتَ عَدُوَّكَ مِنَ الْمُشْرِكِينَ فَادْعُهُمْ إِلَى ثَلَاثِ خِصَالٍ أَوْ خِلَالٍ: فَأَيَّتُهُنَّ مَا أَجَابُوكَ مِنْهَا فَاقْبَلْ مِنْهُمْ، وَكُفَّ عَنْهُمْ، وَادْعُهُمْ إِلَى الْإِسْلَامِ، فَإِنْ هُمْ أَجَابُوا فَاقْبَلْ مِنْهُمْ، وَكُفَّ عَنْهُمْ، ثُمَّ ادْعُهُمْ إِلَى التَّحَوُّلِ مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ، وَأَخْبِرْهُمْ أَنَّ لَهُمْ مَا لِلْمُهَاجِرِينَ، وَعَلَيْهِمْ مَا عَلَى الْمُهَاجِرِينَ، فَإِنْ هُمْ أَبَوْا أَنْ يَتَحَوَّلُوا مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ، فَأَخْبِرْهُمْ أَنَّهُمْ يَكُونُونَ كَأَعْرَابِ الْمُسْلِمِينَ، يَجْرِي عَلَيْهِمْ حُكْمُ اللهِ الَّذِي يَجْرِي عَلَى الْمُؤْمِنِينَ، وَلَا يَكُونُ لَهُمْ فِي الْفَيْءِ وَالْغَنِيمَةِ شَيْءٌ، إِلَّا أَنْ يُجَاهِدُوا مَعَ الْمُسْلِمِينَ فَإِنْ هُمْ أَبَوْا أَنْ يَدْخُلُوا فِي الْإِسْلَامِ، فَسَلْهُمْ إِعْطَاءَ الْجِزْيَةِ، فَإِنْ فَعَلُوا فَاقْبَلْ مِنْهُمْ وَكُفَّ عَنْهُمْ، فَإِنْ أَبَوْا فَاسْتَعِنْ بِاللهِ وَقَاتِلْهُمْ، وَإِنْ حَاصَرْتَ أَهْلَ حِصْنٍ فَأَرَادُوكَ أَنْ تَجْعَلَ لَهُمْ ذِمَّةَ اللهِ وَذِمَّةَ نَبِيِّهِ ﷺ، فَلَا تَجْعَلْ لَهُمْ ذِمَّةَ اللهِ وَلَا ذِمَّةَ نَبِيِّهِ، وَلَكِنِ اجْعَلْ لَهُمْ ذِمَّتَكَ وَذِمَّةَ أَبِيكَ، وَذِمَمَ أَصْحَابِكُمْ، فَإِنَّكُمْ إِنْ تُخْفِرُوا ذِمَّتَكُمْ وَذِمَّةَ آبَائِكُمْ أَهْوَنُ عَلَيْكُمْ مِنْ أَنْ تُخْفِرُوا ذِمَّةَ اللهِ وَذِمَّةَ رَسُولِهِ ﷺ، وَإِنْ حَاصَرْتَ أَهْلَ حِصْنٍ فَأَرَادُوكَ عَلَى أَنْ تُنْزِلُوهُمْ عَلَى حُكْمِ اللهِ فَلَا تُنْزِلْهُمْ عَلَى حُكْمِ اللهِ، وَلَكِنْ أَنْزِلْهُمْ عَلَى حُكْمِكَ فَإِنَّكَ لَا تَدْرِي أَتُصِيبُ حُكْمَ اللهِ فِيهِمْ أَمْ لَا.
Translation
✧ When the Messenger of God ﷺ appointed a commander over an army or an expedition, he enjoined him in his own person to fear God and to treat those with him among the Muslims well. Then he said: Go forth in the name of God, in the path of God. Fight those who disbelieve in God. Go forth and do not act treacherously, do not mutilate, do not steal from the spoils, and do not kill a child. When you meet your enemy among the polytheists, call them to three qualities or traits. Whichever of them they respond to, accept from them and refrain from them. Call them to Islam; if they respond, accept from them and refrain from them. Then call them to move from their land to the land of the emigrants, and tell them that they will have what the emigrants have and be subject to what the emigrants are subject to. If they refuse to move from their land to the land of the emigrants, tell them that they will be like the Bedouin Muslims: the judgment of God will apply to them as it applies to the believers, and they will have no share in the fay' and the booty, unless they fight alongside the Muslims. If they refuse to enter Islam, then ask them to give the jizya. If they do, accept from them and refrain from them. If they refuse, seek help from God and fight them. If you besiege the people of a fortress and they ask you to grant them the protection of God and the protection of His Prophet ﷺ, do not grant them the protection of God or the protection of His Prophet, but grant them your protection and the protection of your father and the protections of your companions, for if you violate your protection and the protection of your fathers, that is easier for you than violating the protection of God and the protection of His Messenger ﷺ. If you besiege the people of a fortress and they ask you to bring them down according to the judgment of God, do not bring them down according to the judgment of God, but bring them down according to your judgment, for you do not know whether you will hit upon the judgment of God concerning them or not.
