✧ Food taken in enemy territory

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: أَخْبَرَنِي سُلَيْمَانُ بْنُ مُوسَى قَالَ:

لَا يَبْقَى الطَّعَامُ فِي أَرْضِ الْعَدُوِّ، وَلَا يُسْتَأْذَنُ فِيهِ الْأَمِيرُ، يَأْخُذُهُ مَنْ سَبَقَ إِلَيْهِ، إِلَّا أَنْ يَنْهَى الْأَمِيرُ عَنْهُ، فَيُتْرَكُ بِنَهْيِهِ، فَإِنْ بَاعَ مِنَ الطَّعَامِ شَيْئًا بِوَرِقٍ أَوْ ذَهَبٍ فَلَا يَحِلُّ لَهُ، هُوَ حِينَئِذٍ مِنَ الْغَنَائِمِ " قَالَ: هَذِهِ السُّنَّةُ وَالْحَقُّ عِنْدَنَا

Translation

✧ Food does not remain in enemy territory, and the commander is not asked permission for it. Whoever reaches it first takes it, unless the commander forbids it, in which case it is left because of his prohibition. If he sells any of the food for silver or gold, it is not lawful for him; at that point it is from the spoils. He said: This is the Sunnah and the truth in our view.
