عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ لَيْثٍ، وَابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ قَالَ:
إِذَا أَصَابَهُ مُتَعَمِّدًا لِحُرُمِهِ مُتَعَمِّدًا لِقَتْلِهِ لَمْ يُحْكَمْ عَلَيْهِ، وَإِذَا أَصَابَهُ مُتَعَمِّدًا لَهُ نَاسِيًا لِحُرُمِهِ حُكِمَ عَلَيْهِ
Translation
✧ If he takes it deliberately regarding its inviolability, deliberately killing it, no judgment is passed against him. And if he takes it deliberately for it but forgetful of his ihram, judgment is passed against him.
