عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ،

فِي رَجُلٍ اسْتَفَادَ مَالًا فَمَكَثَ حَتَّى إِذَا لَمْ يَبْقَ بَيْنَهُ وَبَيْنَ أَنْ يَحِلَّ فِيهِ الزَّكَاةُ إِلَّا يَوْمٌ وَاحِدٌ أَصَابَ أَلْفًا ؟ قَالَ: يُزَكِّيهِمَا جَمِيعًا، وَإِذَا كَانَ لَهُ مَالٌ قَدْ كَانَ يُزَكِّيهِ، فَذَهَبَ إِلَّا دِرْهَمًا وَاحِدًا، ثُمَّ أَصَابَ مَالًا قَبْلَ وَقْتِ زَكَاتِهِ بِشَهْرٍ أَوْ شَهْرَيْنِ، أَوْ أَقَلَّ، ثُمَّ سُرِقَ ذَلِكَ الدِّرْهَمُ، قَالَ: يُزَكِّي مَالَهُ الَّذِي اسْتَفَادَهُ؛ لِأَنَّهُ كَانَ قَدْ أَصَابَ الْمَالَ، وَالدِّرْهَمُ فِي مِلْكِهِ، قَالَ سُفْيَانُ: وَإِنِ ابْتَاعَ بَزًّا بِمِائَتَيْنِ، فَزَادَ عِنْدَ الْحَوْلِ حَتَّى بَلَغَ أَلْفًا زَكَّى الْأَلْفَ، فَإِنْ نَقَصَ بَعْدَ مَا بَلَغَ الْأَلْفَ إِلَى مِائَةٍ، لَمْ يُزَكِّهَا، قَالَ سُفْيَانُ: فِي رَجُلٍ اشْتَرَى دَابَّةً أَوْ سِلْعَةً لِتِجَارَةٍ بِمِائَةٍ وَتِسْعِينَ، ثُمَّ نَمَتْ حَتَّى بَلَغَتْ قِيمَتُهَا أَلْفًا، أَوْ أَكْثَرَ ؟ قَالَ: لَيْسَ فِيهَا زَكَاةٌ حَتَّى يَصْرِفَهَا فِي غَيْرِهِ لِأَنَّ الثَّمَنَ الَّذِي اشْتَرَاهَا بِهِ لَمْ يَكُنْ فِيهِ زَكَاةٌ، فَإِذَا صَرَفَهَا فِي غَيْرِهَا لَمْ يُزَكِّهَا حَتَّى يَحُولَ عَلَيْهِ الْحَوْلُ، وَإِذَا اشْتَرَاهَا بِمِائَتَيْنِ، فَبَلَغَتْ عَشَرَةَ دَرَاهِمَ، فَلَيْسَ عَلَيْهِ فِيهَا زَكَاةٌ وَإِنِ اشْتَرَاهَا بِمِائَتَيْنِ، فَبَلَغَتْ أَلْفًا فَعَلَيْهِ زَكَاةُ الْأَلْفِ؛ لِأَنَّ الْأَصْلَ كَانَتْ فِيهِ الزَّكَاةُ، قَالَ: إِذَا اشْتَرَى رَجُلٌ سِلْعَةً لِلتِّجَارَةِ، ثُمَّ بَدَا لَهُ أَنْ يَمْسِكَهَا بَعْدُ، فَقَدْ نَقَضَ التِّجَارَةَ، فَإِنْ بَدَا لَهُ أَنْ يَجْعَلَهَا فِي تِجَارَةٍ، فَلَيْسَ عَلَيْهِ فِيهَا زَكَاةٌ حَتَّى يَصْرِفَهَا، قَالَ سُفْيَانُ فِي رَجُلٍ لَهُ عَلَى رَجُلٍ مِائَتَا دِرْهَمٍ فَقَضَاهُ مِائَةَ دِرْهَمٍ ؟ فَلَيْسَ عَلَيْهِ فِيهَا زَكَاةٌ حَتَّى يَأَخُذَ الْأُخْرَى، إِلَّا أَنْ يَكُونَ عِنْدَهُ مَالٌ، فَيَضَعُهَا مَعَ مَالِهِ، فَيُزَكِّيهَا فَإِنْ أَخَذَ الْمِائَتَيْنِ، وَلَيْسَ عِنْدَهُ مَالٌ غَيْرُهُمَا زَكَّى الْمِائَتَيْنِ مَرَّةً لِأَنَّهُ إِذَا أَخَذَ مِنْهَا خَمْسَةَ دَرَاهِمَ لَمْ يَكُنْ فِي بَقِيَّتِهَا مَا تَجِبُ فِيهِ الزَّكَاةُ، قَالَ: وَمَنْ كَانَ عِنْدَهُ بَزٌّ فَقَوَّمَهُ قِيمَةً فَبَلَغَ أَلْفَ دِرْهَمٍ، فَلَمْ يُزَكِّهِ حَتَّى نَقَصَ إِلَى خَمْسِمِائَةِ دِرْهَمٍ فَعَلَيْهِ زَكَاةُ الْأَلْفِ، وَإِنْ كَانَ قَوَّمَهُ خَمْسَ مِائَةٍ، ثُمَّ تَرَكَهُ حَتَّى بَلَغَ أَلْفًا، فَلَيْسَ عَلَيْهِ إِلَّا زَكَاةُ خَمْسِمِائَةٍ، وَإِنْ كَانَ عِنْدَهُ بَزٌّ فَقَوَّمَهَا مِائَةً حَتَّى بَلَغَ أَلْفًا فَلَيْسَ فِيهِ.

Translation

✧ About a man who acquired wealth and waited until there remained between him and the due date of zakat only one day, then acquired a thousand? He said: He pays zakat on both of them together. If he has wealth that he used to pay zakat on, and it is gone except for one dirham, then he acquires wealth before the time of its zakat by a month or two, or less, then that dirham is stolen, he said: He pays zakat on the wealth he acquired, because he had acquired the wealth while the dirham was in his possession. Sufyan said: If he buys cloth for two hundred, and it increases at the time of the year until it reaches a thousand, he pays zakat on the thousand; but if it decreases after reaching a thousand to one hundred, he does not pay zakat on it. Sufyan said: About a man who buys an animal or a commodity for trade for one hundred and ninety, then it grows until its value reaches a thousand or more? He said: There is no zakat on it until he converts it into something else, because the price he bought it with did not have zakat due on it. If he converts it into something else, he does not pay zakat until a year has passed over it. If he buys it for two hundred and it reaches ten dirhams, then there is no zakat on it; but if he buys it for two hundred and it reaches a thousand, then zakat is due on the thousand, because the original had zakat due. He said: If a man buys a commodity for trade, then later decides to keep it, he has annulled the trade; if he later decides to put it into trade, there is no zakat on it until he converts it. Sufyan said about a man who is owed two hundred dirhams by another man, and he is paid one hundred dirhams: There is no zakat on it until he receives the rest, unless he has other wealth and combines it with his wealth, then he pays zakat on it. If he receives the two hundred and has no other wealth besides them, he pays zakat on the two hundred once, because if he took five dirhams from it, the remainder would not reach the zakat threshold. He said: Whoever has cloth and appraises it at a value reaching a thousand dirhams, but does not pay zakat until it decreases to five hundred dirhams, he must pay zakat on the thousand. If he appraised it at five hundred, then left it until it reached a thousand, he only pays zakat on five hundred. If he has cloth and appraises it at one hundred, then it reaches a thousand, there is no zakat on it.
