✧ Charity of the slave and the mukatib

عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
رَاجَعْتُ عَطَاءً فِي مَالِ عَبْدِي، فَقُلْتُ: إِنَّهُ مَوْضُوعٌ عِنْدِي، عَلِمْتُ أَنَّهُ نَاضٌّ، لَيْسَ عَلَيْهِ دَيْنٌ لِأَحَدٍ، وَلَا يَتَّجِرُ فِي شَيْءٍ، وَلَا يُلَابِسُ النَّاسَ قَالَ: قَدْ عَلِمْتَ أَنَّهُ لَيْسَ عَلَيْهِ شَيْءٌ لِأَحَدٍ ؟ قَالَ: وَلَا زَكَاةَ فِيهِ، قَالَ: يُقَالُ: " لَا يُلْحَقُ عَبْدٌ فِي دِيوَانٍ، وَلَا يُؤْخَذُ مِنْهُ زَكَاةٌ "، قُلْتُ: زَكَاةُ الْمَالِ ؟ قَالَ: " نَعَمْ
Translation
✧ I went back to 'Ata' concerning the property of my slave, and I said: "It is deposited with me, and I know that it is cash, with no debt owed to anyone, and he does not trade in anything nor mix with people." He said: "Do you know that he owes nothing to anyone?" I said: "Yes." He said: "And there is no zakah on it." He said: "It is said: 'A slave is not enrolled in a diwan, nor is zakah taken from him.'" I said: "Zakah on the property?" He said: "Yes."
