عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، وَقَتَادَةَ، قَالَا:
إِذَا كَانَ الْمَجْنُونُ لَا يَعْقِلُ، فَقَتَلَ إِنْسَانًا فَالدِّيَةُ؛ لِأَنَّ عَمْدَهُ خَطَأٌ، وَإِنْ كَانَ يَعْقِلُ فَالْقَوَدُ
