عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
قُلْتُ لِعَطَاءٍ: حُرٌّ قَتَلَ حُرًّا، وَعَبْدًا خَطَأً ؟ قَالَ: " دِيَةُ الْحُرِّ، وَدِيَةُ الْعَبْدِ، قُلْتُ: فَعَمْدًا ؟ قَالَ: " يُقْتَلُ بِالْحُرِّ، وَيَغْرَمُ الْعَبْدَ إِلَّا أَنْ يَكُونَ مَضَتِ السُّنَّةُ بِغَيْرِ ذَلِكَ، وَلَوْ قَتَلَ حُرَّيْنِ كَانَ قَطُّ، قَالَ: قُلْتُ: فَكَيْفَ يُقْتَلُ بِالْحُرِّ وَيَغْرَمُ أَهْلُ الْحُرِّ ثَمَنَ الْمَمْلُوكِ ؟ وَلَا أَعْلَمُ هَذَا إِلَّا عَنْ عَمْرِو بْنِ شُعَيْبٍ قَالَ: " لَا أَعْلَمُ إِلَّا أَنْ يُقْتَلَ بِالْحُرِّ، وَيَغْرَمَ ثَمَنَ الْمَمْلُوكِ
