عَبْدُ الرَّزَّاقِ، عَنِ ابْنِ جُرَيْجٍ قَالَ:
قُلْتُ لِعَطَاءٍ: عَبْدٌ قَتَلَ حُرًّا عَمْدًا قَالَ: فَالْعَبْدُ لَهُمْ، قُلْتُ: فَأَرَادَ سَيِّدُ الْعَبْدِ أَنْ يُعْطِيَ الدِّيَةَ، وَيَفْدِيَ عَبْدَهُ، وَأَبَى أَهْلُ الْحُرِّ إِلَّا الْعَبْدَ قَالَ: " هُمْ أَحَقُّ بِهِ هُوَ لَهُمْ، أَبَى إِلَّا ذَلِكَ "، قُلْتُ: فَإِنْ أَرَادُوا بَعْدُ أَنْ يُسَلَّمَ إِلَيْهِمْ قَتْلُهُ ؟ قَالَ: " يَقْتُلُونَهُ إِنْ شَاءُوا "، فَقُلْتُ: يُقْتَلُ عَبْدٌ بِحُرٍّ ؟ قَالَ: " يُكْرَهُ ذَلِكَ
